This is so not going to hold up. Remember the judge in the Letourno case tried to order her to not associate with the former victim, who was now in his twenties? Struck down as violating First Amendment freedom of association.

Considering what prisons are like, that doesn't seem like much of a "choice". It's like a mugger giving you a choice between beating you up, OR taking your money.

This woman sounds like an utter moron, but this type of sentencing is ridiculous. How the hell is she supposed to stay away from males over 15 and lead any semblance of a life? How's she supposed to work? I guess she can just go on welfare and stay at home, lest she accidentally chat with a male on the street and end up pregnant again. Ironically, women's prison is about the only place she could fulfil her bond.

The idea of bail sanctions is to make them unpleasant... that way the alleged perpetrator will WANT to come back to court. If the judge made it easy-peasy, she wouldn't want to show back up, and it'd be a real PiTA for the court system... even more then it is now.

Keep in mind that this sanction is just that- a bail sanction, not a punishment. It stands only until the case is brought to trail, or more likely, pleaded down.

This is a pretty extreme case, and one where I would like to see the judge have the right to order a sterilization procedure- she's 20, and has had 4 kids. Obviously she is neither mature nor intelligent enough to actually have kids or stop having unprotected sex, so she needs to have the ability to reproduce removed. If in the unlikely case that she matures in the next couple of decades and wants to have kids, the procedure IS reversable. And if you want to cry about the cost of having 2 surgeries for her, just compare it to the cost of the state raising just ONE of her children.

Duh. This judge obviously never took Teenagers 101, in which he would have noted the first rule of teenagers: the best way to get them to do somethin' is to forbid them from doin' it. This has already been demonstrated to work with sex in particular. This chick is only 20, which is only one year removed from bein' a teenager. Same rules still apply. Nowhere in the constitution is the government given the right to do any of this. Damn, that's a crappy argument. I expect better out of you. It's also much more efficient to take all guns away from people and lower handgun crimes. If people didn't have any rights at all, policing them gets downright easy. It's nonsense, though, and you know it. As humans, we're sometimes not free to have a perfectly easy answer, no matter how much we might want one.

Since the government has the right to execute you- the ultimate punishment- they also, by default, have the right to any interim punishment on the way to execution. There is this impression that we can't change our government, that we get what is there and that is all. The truth is that we get the government we deserve, predicated on our ability to fight as a people. It's not a one person job. This is why when you see the poeple around you complacent you have to wake them up.

Rights battles are always fought for unloved entitites. Why is the ACLU continually protecting scumbags? Because when an attack on your liberties comes, it won't be an attack on puppy dogs and nuns, smiling children and wealthy white males. It will be an attack on a scumbag. That's how the precedents will be built to take away your rights.

It is a slippery slope. The way I see it, po' folk have just as much of a social responsibility as any other social class. The middle & upper class get stuck w/ the bill to raise these kids. Plus we're aware of the downsides of children being shuffled thru the social care system. This "woman" has a social responsibility to stop having any more, even if temporarily, and get her ass in line so she can take care of the ones she has.
