Interesting thing... a Kiss has 25 calories. If you kiss someone for 1 minute, you burn 25 calories. The machine that makes Hershey kisses looks like it's kissing the conveyer belt.

Any hot girls want a Hershey's Kiss and burn it off with me? =)

That is true. However, Hershey has used the mark Milk Duds on clothing. From my experience doing appeals before the Trademark Trial and Appeals Board, I think that Hershey has a good shot here. You can read their opposition at http://ttabvue.uspto.gov/ttabvue/v?pno=91166974&pty=OPP&eno=2

In reading Hershey's Notice of Opposition, I came across one sentence that makes me question whether or not I want to ever eat any Milk Duds again. Hershey notes that the MILK DUDS mark has been used forever and is famous. Then, however, they insert the following (probably stock) sentance.

"8. Applicant's Mark [MILKDUDZ] is confusingly similar to Opposer's Mark [MILK DUDS] in appearance, sound, and meaning."

I don't disagree that the two marks are similar in appearance and sound. Meaning? MILKDUDZ is obviously about clothing for boobies. MILK DUDS has a similar meaning? I am afraid of what Hershey envisions the meaning of their mark to be (and what does it have to do with boobies).

It probably has to do with the fact that Hershey's sells t-shirts with names of their candies on them. They probably don't want people confusing unoffical shirts with official ones.

I think it's a great name. If I were still breastfeeding children, I'd buy some.

I also think the fact that candy and clothing aren't in the same market will allow the clothing line to keep its name.
