Yeah, farking underage is a big no-no so we have to protect the children with legislation, but we won't worry that they're all starving and dying because they have no clean water and food. The world is mad.

If you're going to have a law enforcing public morality, you have to go with the values of the majority of the public. That's democracy. If great numbers of people break the law, and there is no popular outcry when the law is repealed, this must mean that the law does not enforce popular morality and therefore should be abolished.

You could argue that the girls in question are harmed by the law and could not possibly enjoy sex at that age, but I (and a few Sri Lankans) would want to see the proof of it.

No- anyone who is under [insert age of consent for area you are in] is incapable of giving informed, legal consent. In other words, it doesn't matter if the 12 year old said she wanted to do it, she is not legally capable of determining that for herself.

Over the age of consent they can say yes or no, under they are an automatic no regardless of what they say. In the U.S., we have the same policy with regard to drugs and alcohol. Drunk = no consent.

Why do you think second/third-world countries have age of consent laws? Usually, its not to protect the children, but its to 'save face' in front of the world's community, or to get foreign aid, etc.

Think about it. Imagine if there were a country that was 100% more peaceful than any other country. No crime, etc. But it didn't believe in 'age of consent' laws and prosecuted farked-up cases on a case-by-case basis. Now imagine that Perfect gets hit by an earthquake or tsunami.

It's not so much that someone underage is incapable of giving consent - that is taken into account by the judge (in the UK we have a second age.. 11 or 12 IIRC, where consent is deemed to be legally impossible, but above that it's considered in all cases).

Doesn't cut much ice with some judges - 16 year olds have been thrown in jail for having sex with their 15 year old girlfriends (although that's the exception rather than the rule, otherwise half the schools would be empty!).
