Again?

2005-09-14 02:10:16 PM
The 9th Circuit strikes again.

2005-09-14 02:10:21 PM
So how will this help kids who don't want to and get their asses kicked by the other kids reciting nationalist rhetoric from their parents in an effort to show their American "pride".

2005-09-14 02:10:35 PM
"Limbaugh and Hannity's heads simultaneously exploding."

As this is Fark, I believe that should be "asplode".

2005-09-14 02:11:14 PM
It was as if millions of Freepers screamed out, and were suddenly silenced...

2005-09-14 02:13:14 PM
Well sure, it's a violation of the kids 78th amendment rights.

emidln: So how will this help kids who don't want to and get their asses kicked

They should know how to fight, anyway.

Activist Judges!!!!!

rickythepenguin: The 9th Circuit strikes again.

Do judges get labeled "activist judges" only when they make a decision with which you disagree?

2005-09-14 02:15:05 PM
Now that we are no longer at war with the godless commies, but with the god-obsessed terrorists, shouldn't we change the pledge back?

2005-09-14 02:15:58 PM
Huh? What? Didn't we do this already? Farking deja vu?

2005-09-14 02:16:09 PM
Now that we are no longer at war with the godless commies, but with the god-obsessed terrorists, shouldn't we change the pledge back?

Like hell that's gonna happen. And I've never understood the whole American pledge of allegience thing...it seems really weird...

Gecko Gingrich: Do judges get labeled "activist judges" only when they make a decision with which you disagree?

Isn't that always the definition of activist judges, whether from the left or right?

2005-09-14 02:16:28 PM
I really don't see the harm in restoring the pledge back to it's original wording, and not the Red Scare version.

Gecko Gingrich: Do judges get labeled "activist judges" only when they make a decision with which you disagree?

Of course.

Interesting to see this, considering that the topic of this month's state bar mag (porn for attorneys) is whether the 9th should be split.

cruci fiction: Now that we are no longer at war with the godless commies, but with the god-obsessed terrorists, shouldn't we change the pledge back?

That would make too much sense.

2005-09-14 02:17:48 PM
Okay, now I am interested... What was the consensus, ricky?

2005-09-14 02:17:54 PM
leperboy69: And I've never understood the whole American pledge of allegience thing..

I was born a citizen of the USA. I don't need a farking pledge to test my allegiance.

The whole thing reeks of jingoistic McCarthy Bullshiat. This is 2005, not 1955.

2005-09-14 02:19:29 PM
No, that sound was their collective hard-on springing up against their over-starched pants as they think of the years worth of new material they've just been handed on a silver platter.

2005-09-14 02:19:39 PM
I always found it funny how teachers would complain there wasn't enough time in the school day to teach and there was talk of making us go longer, yet we wasted time every freaking morning reciting the pledge and singing the patriotic song of the week.

/Still hates "The Battlehymn of the Republic" with a passion
//Hated "God Bless America" before it was cool

2005-09-14 02:19:51 PM
Teekno: Isn't that always the definition of activist judges, whether from the left or right?

That was kinda my point. I would, however, like to point out that I have never heard a judge labeled a "damn activist judge" by the left. Not saying it hasn't happened, just that it must be so infrequently, that it doesn't get the press like when the right bandies it about.

2005-09-14 02:20:13 PM

The whole "under God" thing is a right old laugh as well ; so much for separation of church and state.

rickythepenguin:

Conservative 9th Cir. Judge Alex Kozinski, one of my favorites, wrote an op-ed (for the WSJ I think) a few months back, and concluded that doing so would be an inefficient administrative nightmare that would wreak havoc on caselaw in the divided circuits. I tend to agre with him.

2005-09-14 02:21:00 PM
Don't worry this will get over turned by the time it gets to the Supreme Court again. This time the court will pull to the right so hard, they wont just dismiss it.

Gecko Gingrich: Do judges get labeled "activist judges" only when they make a decision with which you disagree?

He's a lawyer, so I'd say no.

Guess again.

whidbey: The whole thing reeks of jingoistic McCarthy Bullshiat. This is 2005, not 1955.

(As has been said)...that's because the under God part was added in 1954 - mostly to identify red blooded americans as god lovers, as opposed to those god fearing pinko bastards.

2005-09-14 02:23:13 PM
Is this a rerun? Didn't we already do this a couple of years ago ...?

2005-09-14 02:23:37 PM
whidbey: I was born a citizen of the USA. I don't need a farking pledge to test my allegiance.

And how do they make a child say it anyway? Isn't it meaningless? In a sense, isn't it like asking the child to enter into a contract? And by law children cannot do so (right?)

Some sanity emerges from that which is our Federal Theocracy!

2005-09-14 02:23:55 PM
Iron Hand: Okay, now I am interested... What was the consensus, ricky?

I haven't read the article yet. But its old news; folks have been bumping the gums about splitting the 9th for years.

Arizona's former governor spent a bit of time basically lobbying for AZ to be removed from the hippie liberal 9th and moved to the more conservative 10th. He was mad at how the 9th was too soft on crime and to indulgent on appeals.

Of course when he was found guilty of several felony offenses (fraud), he was singing a different tune. The 9th eventually overturned his convictions (jury misconduct, as I recall) and while prosecutors considered re-trying him, Billy Clinton pardoned J. Fife on his very last day in office.

And so our governor entered chef school and is now a pastry chef for an upscale ristorante in Scottsdale.

2005-09-14 02:23:55 PM
It's really only a temporary thing. I've written a new one which is going to be put in place in about two years.

See, the government took the success of the Coke II/New Coke/Coke Classic thing and applied it to patriotism. They contacted me and asked if I could come up with a new pledge, the reasoning being that after two years with no pledge, nobody would remember the first pledge and they'd accept my version as the one grandma and grandpa used to listen to while they had sex:

I pledge allegience, to the flag,
with twelve crisp new five dollar bills.
And with this money,
I shall pay,
webmasterjoe,
via paypal,
And hope that he can buy some new stuff.
Amen.

Keep your eyes peeled.

2005-09-14 02:24:04 PM
Don't they mean "forcing" children to say it?

I hear the constitution hates blacks.

2005-09-14 02:24:04 PM
Well... this should be a fun topic on fark

ArcadianRefugee: And how do they make a child say it anyway?

I went to catholic school until about 4th grade. The nuns were very persuasive with their 3 feet of pain they would bring down on us if we didn't participate.

2005-09-14 02:25:11 PM
why does america hate america?

2005-09-14 02:25:20 PM
what Jerko McGee said.

2005-09-14 02:25:23 PM
Hannity and Rush upset about this? Yeah, right. They love this kind of stuff, because it allows them to continually mislead their listeners, who think that the godless athiests are the reason they can't get a job, health care, or have a happy relationship. I doubt Rush or Hannity could care less.

2005-09-14 02:25:24 PM
morren

Don't they mean "forcing" children to say it?

No that was established back in the 1940s.

2005-09-14 02:25:31 PM
Since this will be repeated ad-nauseum I'm going to get my kicks in:

Damn Activist Judges!

2005-09-14 02:25:31 PM
Let's be honest here. Think back to your school days.

Did you actually say the pledge, or did you just stand up, put your hand over your heart and space out for thirty seconds, thinking about the rack on the girl next to you or how you were going to write 200 words on franklin pierce before 4th period?

/submitter. sorry for the "Asspolde" omission

2005-09-14 02:25:35 PM
It's also interesting that the Pledge was written by a socialist. And then "under God" was added during the McCarthy era.

2005-09-14 02:25:36 PM
Much, much, much, much, MUCH - ado about nothing.

2005-09-14 02:25:39 PM
Oh no. And here I was about to comment.
