What legal recourse would they have to sue him over their mistyped check, especially since they had his name and address on it.

Well, actually, a clerk at Mars Music explained that to me once. It seems that, if you can prove that you did not receive anything in exchange from your cheque, then you can cancel it without consequence. This is why they did not accept third-party check. They were burned more than once by cancelled cheque, and the guy won at court, because he was not the one who got the purchased product.

IANAL but I think it goes something like this...if you cash a check you know that you are not entitled to and keep the money that is theft by fraud and is prosecutable.
