asinine -- why ?

this may seem harsh, (and i know this was in mexico) but that is the whole reason we have jay-walking laws.

if a pedestrian causes and automobile accident, there has to be a crime to charge them with.

being on foot does not always give you the right or way with respect to a car.

I don't think this is asinine at all.

Here in Colorado a pedestrian always has the right of way, even if s/he is jay-walking. I can't tell you how many times idiots have walked right out in front of my car and almost killed themselves. If I had hit them it would have been my fault even though they were the ones being stupid.

I hit a pedestrian who walked out in front of my car. I was moving in a line of traffic and she didn't even look when she just started crossing the street. She even admitted that she hadn't even looked. Her story changed when the cops arrived. Several wittnesses heard her though, and told the cops what they had seen and heard.

They wrote her a ticket but I never filed a claim against her. I still point to the dent in the hood of my Jeep where her head went "clang".

I agree that this isn't asinine.

It would be nice if cops wrote out tickets for jaywalking. There was a guy jaywalking that caused traffic to have to stop. The cop in front of me, who also had to stop, did bupkus. I honked at a guy doing this and he flipped me off.

This nonsense about pedestrians having the right of way is bullshiat.

Not true. Colorado Revised Statutes section 42-4-803 states: "Every pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway."

Here walking, running, playing, and generally standing in the farking road is like this damn city's favorite pastime.

It's like the locals were PURPOSELY educated incorrectly on our farking road system. They bike against traffic on one way streets, they stand in the road, they run with traffic. Its insane and we get LOTS of injuries because of it.

this isn't good, it's freaking great. Anyone that's been to both Boston and New York can tell you the difference (pedestrian wise) is that people in Boston are farking ignorant of traffic laws. I'd be happy with a law that let you mow them down for not looking.

They do over here. I remember a few years back, they ran a big ticketing operation at the middle school I went to. While some people called it a grab for money (tickets were $50 each), I called it "about damn time". Those little bastards would walk out into the street without any precautions whatsoever. I always drove slowly though there of course, but it still annoyed me how these punks had no regard for the fact that I could smear them all over the road if I wanted to. They totally expected the cars to stop for them.

Under those circumstances, I would keep the trophy dent as well (though I probably would have gotten the money for its repair anyway ... gotta pay my insurance somehow).

Accidents happen, and sometimes there's both sides to blame, that's what the cop told me.

That old guy didn't look where he was going, was lost in his headphones, and told the paramedics as much.

And there were too many cars to the immediate left lane to see him coming, or for the jogger to see our car.

Sure we were smoking opium-laced weed and huffing nitrous in the backseat, but they never found it.

We could've backed over him a few times, but we thought better of it and stopped after number four.

Sometimes everyone shares the blame, especially anyone collecting retirement money.

If he was in the wrong he should pay. But the stuff about the cop being outside his room- I think I heard that in Mexico you can be arrested if there's a civil suit possible / likely in a traffic accident, esp. if you're a gringo. Is that correct? Maybe Dateline even did a story about an American who died because Mexican authorities refused to allow him to get medical care, preferring to arrest him instead. Heck, I don't know.

I disagree, unless this is a new law. My senior year in High school a freshman was hit and because she was jay-walking the driver was not held at fault. To add insult to injury the cop then told her that she was lucky that she was so "healthy" because of her "padding" her injuries were less severe had she had a "slender build" and then proceeded to write her a ticket for jay-walking.

The pedestrian only has the right of way in a designated cross walk.
