This isn't "STUPID".. FAX Spams are totally illegal. ALL unsolicited FAXers can be sued by anyone that receives their FAX garbage...

I'm trying to find out if I can sue personally, for my business's SPAM Fax problem.. my company won't do it (their legal dept has better things to do than go after $200 here and there, I guess.. but if they multiply that by the entire company's 7000 FAX machines... ) so I'm hoping that I can.. I could use $200-$1000 for every one of the 10-15 FAX spams I receive a DAY.

Agree with the other commenters. It's not as big a problem now precisely because of the law, but there was a time not long ago that junk faxes were almost a big a problem for fax machines as spam is for corporate email accounts. Frequent and aggressive use of the private-recovery portion of the junk fax law is a good thing, and I salute the law firm for taking the time to do it.

I see nothing stupid about this.. at work (small warehouse) we use 10x more much ink and paper on spam faxes than we do on legitimate ones. It wouldn't be so bad if we had a better fax using toner, but we generally don't do enough volume to justify the expense. Every time we call for removal from one of those fax offers, it's the same removal service, removing us from that *one* offer. It's a huge headache, but I can't get my company to switch to an unlisted number or go after these companies.

I researched it a little while ago. You can sue them, but it seems like its damn near impossible to actually get the FCC to do anything. So, good luck.

Um, either your fax machine uses ink or toner, I have yet to hear of one that uses both. Sloppy reporting.
But, still, junk faxes suck. Fax machines have a finite amount of memory. How'd you like to lose your court case, and thousands of dollars (or your freedom) because some junk fax for $99 Florida Vacations punted a valuable document?

teh lawsuit is right...I worked @ a lawfirm this summer and the unsolicited faxes were rediculous. 3 or 4 before lunch and the same after...8 or so a day adds up.

Sorry, but I'm with the lawyers on this one. Spam faxes are a waste of time and money for the recipients. A number of states have laws against the practice, as do the feds. Spam faxers should die.

I did RTA. The "do not call" list was for more than one person/company too. What's your point? This issue needs to be dealt with. Hopefully this lawsuit will set precedent for a "do not fax" list.

/all for tort reform where it applies, like suing McDonald's because you're fat.

Stupid? I think not... Luckily all our faxes come into a linux server that emails them to us.. no cost for printing but still.. I'm sick of ads for buying stocks and travel companys etc... That stacked with my email spam and the fact that I have to spend valuable time stopping them as well (a losing battle) I'd want to see these companies hit where it hurts.. hopefully it will put them under...farkers...

ok, for you guys who are getting the spam faxes, here's what you do.
when bugeting time comes up, ask for an extra $3000 or so, and when they ask why, say it's to compensate the dept for all of the junk faxes they're receiving that the lawyers refuses to go after.
the list out the potential income that could be generated by sending the flying buttmonkeys(read:lawyers) after these idiots:
$200 per fax... 10-15 faxes a day... that's $2000-$3000 a day income :)

if nothing else, shock and anger them with exaggerations and present them with poorly created powerpoint presentations. That's the only way to communicate with PHBs.

Fax bombing.

A short lesson in evil-ness.

This is what you do. Get a sheet of paper and tape something horrible offensive to it. tubgirl or something.

Dial your victims number, then feed the paper in, when its halfway through the reader, loop it outside the fax and tape the ends together, so it runs in a continuous loop. This may take more then 1 sheet of paper.

But boy, is it evil.

I'm siding with the attorneys on this one. The radio station sent a junk fax (a cold call, if you will). That's clearly illegal and the victims are completely justified in pursuing the lawsuit. Perhaps the submitter would care to explain why he/she felt this warranted a 'stupid' tag?
