I thought your license was suspended for a year after your first, five years after your second and your third is a felony, on top of the driving on a suspended license charges.

FTA:

It's the story of an Anaheim cop who hasn't been to work since late 2008, is still on the department's payroll, and notched his third DUI arrest in less than a year March 2.

an Orange County Sheriff's deputy who was arrested on suspicion of driving under the influence after crashing twice in less than 35 minutes. (Cops from his own department had let him drive away after the first accident.

In addition to the special treatment he got for being a cop, his second and third offenses occurred before he was convicted of a first offense. Where I live that would give him three first offenses instead of a first, second, and third offense.

90 days/9 months/2 years respectively, in my state. But yeah, damn... the cops that let him drive away need to be carted in for negligence... they put people at just as much risk as the arsebag they let go...

What they say here is "his performance on the field sobriety test was not conclusive." That was the excuse for giving a city cop a ride home after a drunken wreck. He had a prior offense on his record. We know he was obviously drunk, contrary to the statement of the officer on the scene, because of witnesses at the bar he drove away from. The city couldn't even fire him for that. Can't discipline for drunk driving when the officer on the scene doesn't arrest, and the punishment for being drunk in uniform in the bar was overturned by the civil service review board.

Sounds like an abbreviated list of "What's wrong with this system?" to me.

It depends on your state and I don't know about CA. I do know that in Illinois you get your license back in short order after a misdemeanor DUI though.

He should be fired for off duty activity because he would be unable to work if he was in jail where he should be.

It's no secret that some cops have a problem with alcohol. It's a stressful occupation, the hours are long, and the job wreaks havoc with home life.

And they don't let them smoke pot.

feckingmorons [TotalFark] 2010-03-13 09:57:06 PM
He has not been convicted of any of them.

When he is he will most probably be fired, not because of the misdemeanor conviction, but because he can't drive and that is a condition of employment.

The subsequent convictions, if any would be grounds for firing him as well.

I hope you are right. There's no reason why cops should be treated any differently than the rest of us. (Especially when it comes to driving)

Well, some judges can purposely mess with you. When I was young and dumb, I got a misdemeanor DUI. First offense, clean driving record otherwise. However, this judge was new to the bench and handing out maximum fines and really swinging his weight around. When he found out I was a DJ, he also added to my six month suspnded license that I could also not go into a bar for six months, effectively making me have to quit (he didn't do that to any other DUIs that he tried that day). I hadn't showed him any sass up until then, but he could tell I was fuming. He then taunted me, saying "I guess you better get a McJob", to which I replied "or move to another state!", which I did, the next day.

/was planning on moving soon anyway
//got a job in a bar there immediately

I probably should have included a disclaimer about people who have jobs which involve driving. Clearly, it's a poor idea to have a cab driver with a history of DUIs. I was thinking more generally.

With that stipulation, it's a bit harder to come up with something. Possibly somebody who has a public office(depending on how bad the DUI was), stuff like that. It's hard for me to picture a gas station cashier getting fired for a DUI. Unless they crashed into the gas station they worked at.

GORDON: WHy would an accountant get fired for having 3 DUI's?

I would fire an accountant with 3 DUIs. CPAs can lose their licenses for substance abuse to the extent that it impairs their work.

I can't see how 3 DUIs in a few months can't be impairing his work. That said, there is not a strong CPA union.

My friend had a government job and got fired for a DWI. Whole reason being is that her small city had no news that week and she found herself on the front page of the Sunday paper. Then the local news picked it up and put her face on TV. They got rid of her for "conduct not becoming a federal employee" because people had seen the news. Biatch of it was, her boss had 2 DUIS. Moral of the story: don't get busted on a slow news week.
