Judge from Louisiana killed by giraffe. news at 11.

ZAZ [TotalFark] 2010-03-04 10:45:26 AM
District Judge Brenda Bedsole Ricks signed the temporary restraining order Tuesday

TRO = ex parte?

Regardless, the standard for censorship is so high that the judge shouldn't have granted an injunction whatever the procedure.

Louisiana giraffe suffers from indigestion, film at 11.

Brilleaux's attorney, Parker Layrisson, said his client's work is satire and is considered protected speech.

Only in the civilized world. This does NOT include Louisiana, it would seem.

OK usually with stories like this I can see both sides of the issue, but not here. Seriously, WTF?

ZAZ [TotalFark] 2010-03-04 11:42:57 AM
ne2d

If I write a story about how I was raped by ne2d's pet goat when I went to shop in his store, you may be able to sue me over loss of business if people actually believe they will be goat raped while shopping.

But financial liability after proof of damage is a long way from forbidding publication without even a trial.

To be fair, that story influenced the most powerful person in the country.

Clear violation of first amendment rights... and some people are just stupid.

simpsonfan 2010-03-04 12:15:07 PM
Story should be removed. It mentioned a real place. If they used a fictional zoo, that would be different.

Yes. Satire is definitely expressly forbidden by the 1st amendment.

Louisiana judge is sleeping with a giraffe. Article written by: L. Flynt.

yert 2010-03-04 12:19:47 PM
It's the same giraffe that was having sex with pat robertson's mother in larry flynt's outhouse while being filmed by Michael Moore.

The giraffe was quoted last year saying, "I am an evil giraffe, and I shall eat more leaves from this tree then perhaps I should, so that other giraffes may die."

Being a Simpsons fan, you surely remember the episode A Streetcar Named Marge and the controversy surrounding its satirical description of New Orleans. Are you saying that episode should not have been allowed to air, since New Orleans is a real place?

So if an orca kills its trainer, it can't be reported on because Sea World might lose some business?

Mrbogey 2010-03-04 12:29:42 PM
Having been in the area, I can assure you the animals in the park are harmless... now the animals looking for their fix of meth and/or crack outside the park at Old Uneedus Rd are another matter.

drongozone: So if an orca kills its trainer, it can't be reported on because Sea World might lose some business?

Nope - that was an actual event. Here they're saying the satire is causing attendance to drop. It couldn't be related to the fact that the idiots down there just found out that hunting at the zoo is prohibited.

How is it possible to become a judge in the US without knowing that a ruling like this absolutely, 100% positively will be struck down on appeal?

It's a freakin' non profit wildlife sanctuary for crying out loud. If their business is being hurt by a story that may not appear to be obviously fiction, the proprietor shouldn't have to go to a judge to have it removed. Douchebag Nicholas Brilleaux should have changed the name on request -- or marked it as satire for his numbnut readers. But then he has less attention whoring potential, I guess.

THIS

My guess is she's one of those elected judges. Hell, she may have never seen the inside of a law textbook.

It would help the defendant if the Hammond Action News was actually funny. I think they are in trouble.

How can a non-profit have their business hurt?

I'm starting to wonder if "2theadvocate.com" got duped by Hammond Action News. I don't see any other news story about this.

Cathy Bates, the mother from the movie "Waterboy" with Adam Sandler.... Ya **really** gotta see that movie. It cast my state in **such** a good light.

ne2d: OK usually with stories like this I can see both sides of the issue, but not here. Seriously, WTF?

Aside from the word "sexy" in the header, it's not immediately obvious (if you visit a single story on that site) that it's a satirical news site. Even the disclaimer is hidden behind a hyperlink in the footer.

Contrast this with the Onion, which litters every page with links to parallel articles, making it painfully difficult to NOT know it's satire (even though somehow, people still do).

Not that it makes much difference, but the place is not a zoo. It's a big ol' pasture, and the patrons are driven around in open buslike vehicles. Everything on that website is a spoof, and anybody that takes any of it seriously should be thrown under a buslike vehicle.

flyingmonkeysreign 2010-03-04 12:42:29 PM
Looking at Hammond Action News Link (new window) I would honestly be more worried about the people who believed this was a real story being allowed to drive and being trusted with children.

/same people probably called 911 after seeing Independence Day. THE WHITE HOUSE HAS BEEN DESTROYED!!!

Non-profit =/= free.

Korangulation 2010-03-04 12:43:42 PM
I'm fairly sure defamation and libel are not covered by the first amendment, and this may count as that if the news article isn't obvious that it's satire.
