He isn't in any trouble now. And I doubt he would be in any criminal trouble if someone dies from it. Civil trouble? If his family sues for negligence, they will could barred from recovery because it was the illegal conduct that lead to their death, and he didn't actually sell them. Also, the plaintiff assumed the risk when he took the ecstasy pills that were stolen from a stranger.

But at most he would only be liable in a wrongful death action and the the guy who took the pill would certainly be guilty of some contributory negligence. Depending on the doctrine applied by the court, the plaintiff could be SOL if they are more than 50% liable for their own death.
