In a criminal case like this might turn out to be, its "The People" vs. the defendant, not the victim vs. defendant. The prosecutor will make the decision to press charges or not based on what they think are best.

Apparently in Florida the Police have the ability to prosecute for domestic violence even if both parties don't wish to prosecute (or some such). Read it on one of the many Tiger stories over the weekend. However in Florida, you don't have to talk to the police about traffic accident.

A judge can simply toss it out of court at will, or disect it for seperate custodial rights. If there wasn't a child in the picture when the agreement was made, having the child virtually nullifies everything. It's basically nothing more than judicial toilet paper. The best bet is to make an agreement between the husband and wife in blood and have Satan himself witness and seal the document.
