Psh, My old squadron (AF) used to do this crap. They would look up peoples MySpace accounts, which they had been too careless or stupid to set to private, and look at all the pictures they could find. Sometimes, they would find someone who was like 19 or 20, with a beer in their hand in a picture. Apparently, that is enough to take rank and charge them with underage drinking. There was one guy who was doing a keg stand, which I can kind of agree with on a basis of proof, but the ones who were just holding it seemed sketchy.

/cool story bro

Haha Copper, I wasn't drinking beer.
A warm frothy glass of camel whiz is my beverage of choice.

I didn't realize it was illegal for under-21s to hold a beer in the US.

So, let's see.... a Facebook photo (you know those are never staged) is enough to get you in trouble with the law? And it's ok for police to anonymously target specific college students?

IronOcelot 2009-11-29 08:38:55 AM
This reminds me of the retards back in high school that made and passed out fliers about parties with drawings of bongs and kegs on them, then wondered how the cops knew they were doing underage drinking and smoking weed.
"Man, it's like they're psychic or something!"

Did facebook ever fix that exploit where you could see people's pictures even if they had private accounts and weren't a friend? Or did that only work with friends of friends (i.e. you had to know some part of the url or something already)?

FTA:"Apparently, a college student in Wisconsin accepted a Facebook friend request from a cute girl he didn't know. Shortly thereafter, he got ticketed for underage drinking on the basis of a picture he'd posted of himself holding a beer-in his own home, no less."

Two things:

1. What is the statute of limitations for underage drinking?
2. So now cops can use the image of some "cute girl" as a means of prying into citizens' social lives?

We isn't that creepy

The possession of alcohol by a minor is prohibited in all 50 states. Holding a beer is typically considered possession.

Except when in the presence of parents or guardians. There is no minimum age for alcohol consumption when accompanied by a parent or guardian.

Toss the sorry-ass teens in jail, I say! Even if you have no proof they've done anything wrong.

WOW!!!! The potential is unlimited!!! Photos of fake crimes could send these Bozo cops on wild goose chases all over the country. Watch them chase their tails and make total fools of themselves. If they try to prosecute just say "How was I supposed to know you were a pig, I thought we were playing Mafia Wars" or some other game.

The first defense lawyer that takes this case is going to have the evidence (and thus the case) thrown out on 4th admendment grounds. To perform an operation like this they would need a search warrent.

Just because it's legal doesn't mean it can't be used against you.

After all alcohol is a horribly addictive substance, one sip and anyone and everyone will go flo-sweat and do anything for another drop of that precious, precious nectar. So proof that they have ever so much as held a beer bottle is proof that they have killed your great-grandmother for the shot of whiskey she keeps her dentures in.

dennerman 2009-11-29 09:05:27 AM
In the article the blogger says that there ought to be better things the cops can do with their time. At first I was like, "definitely" but then I thought about it. You could have one officer sitting at his desk issuing five times the amount of citations that one out on the street is able to do. Imagine the statistical bump you get that month. Now, as for actually making the world safer for citizens... well, I guess one could argue that keeping teen drinking down helps safety, but all I think you get from this method is keeping teens from posting pictures of drinking.

That's correct in at least some jurisdictions, but in all US jurisdictions I'm aware of, that doesn't extend to your friends of those children.

Red Light Cams, Face Book Scans, Unmaned Speeding Traps

Then the "Inhome Sexual Monitoring Cams" to make sure you only have Sex in the Missionary Position,

Then will be the Brain "Precrime" Scan

It varies from state to state. Some states do not have exceptions to permit the consumption or possession in the presence of a parent or guardian.

If you post it on the wide-open internet, it ain't private. (boy have I seen a lot doing simple checks on job applicants)

And if you're foolish enough to accept a friend request from someone you don't even know, shame on you.

navarone54 [TotalFark] 2009-11-29 09:22:14 AM
People should realize by now that the internet is a public place. One should not be stupid enough to post pictures of themselves on the internet doing illegal things, and if they do, not be stupid enough to keep public settings on those pictures. It's funny how the cops understand this but teenagers who grew up in the internet era do not.

Glug the Beer Slayer: i wonder how long till the police are sued for invasion of privacy...

How's is it an invasion of your privacy when you post the picture on the internet?!

"Invasion of privacy" is a moral phrase.

The legal phrase is "expectation of privacy." If you expect that pictures posted on facebook will remain only seen by you and your close friends, you're an idiot.

More importantly, while most countries have a legal drinking age, in the non-batshiat insane ones what happens when you drink while underage is the cops take your drink and send you home. Being punished is something I would expect in Iran. Americans love to rant about freedom but don't care that they live in a police state, as evidenced by how all the comments here are about how the kids are stupid, not the insanity of a drinking ticket.

Ok, so there are 8 states that chose to explicitly interfere with a parents rights when it comes to raising their children.

Should have been obvious to me, I guess.

Parents who love their children teach them how to drink responsibly.

This is a Federal felony.

Because some people realize that the browser has a "back" button and prefer not to open a million windows or tabs?
