"As a condition of Tharpe's probation, she will be required to speak at mortgage fraud forums by the District Attorney's Economic Crimes Bureau or the New York State Attorney General's Office"

Well they say that those who can't....teach

I'll forget about this article in about 10 minutes. :|

Slap on the wrist, if this was china they would be put to death, and the worth would be better for it.

I may have alzheimers but at least I don't have alzheimers

A Brentwood, Long Island woman was sentenced to 30 days in jail and five years probation for stealing the home of a 93-year-old Queens man suffering from Alzheimer's disease

30 days in Jail? Seriously?

Quinzy 2009-11-24 01:35:33 PM
I agree with the sentiment that their punishments are a joke. A few months jail then probation. For sticking it to an old senile man. Wow..

There's a special circle of Hell reserved for people like this, and the cronies who let them off with 30 days plus probation.

moops 2009-11-24 01:38:14 PM
what, did they steal the grocery bags of poo that the occupant had been leaving around the house, in order to ward off burlgars on the second floor of their ranch house?

So, say, if I embezzle $200k from my employer, ya think I could get 30 days (15 with good behavior)?

And that.

There was an Alzheimers protest march in our town last week.

"What do we want?"
"Can't remember!"
"When do we want it?"
"Want what?"

So she gets a slap on the wrist and has to give the equivalent of a book report.

thats f*cked. shoulda used "sick" tag. i can't believe they are getting off so easy. makes it seem almost worth it to do something like that. that's not how punishments should be, i mean what the hell, people get much longer sentences for stealing a stereo from best buy or something.

Sad to say this but at least the guy doesn't remember anything.

I'm glad to see I'm not the only one outraged by this. Wanna bet there'll be public shaming now and that these people will be harassed and humiliated now because of this story? I sure hope so.

Adam Sandler once stole a woman's hole who had anterograde amnesia and he ended up getting a boat, a wife and a daughter out of it

Man, that's some deterrent to committing theft to the tune of six figures.

Meanwhile, I would guess the crime of slinging a rock of crack while being a black kid in Long Island will still get you a stretch of time numbered in years.

Hell getting caught with a joint in some states will get you that many days..

//Of course, it's not like it's not well established that our laws are arbitrarily fair anyhow..

Crime cannot be tolerated. Criminals thrive on the indulgence of society's understanding.

Forced Perspective 2009-11-24 01:48:02 PM
Wow, okay, let's see if we can spot all the mistakes:

93-yeat-old

stealing the home of a 93-year-old Queens man suffering from Alzheimer's disease and then let it fall into foreclosure.
(should be "letting")

A civil court case is presently pending before Supreme Court Justice Howard Lane. (as opposed to 'past pending?')

Okay, your turn. That last paragraph explaining what she has to talk about may not be technically wrong, but is as awkward as all hell.

By the looks of the mob sharpening their pitchforks in here, I think there's very little understanding from society's side. I think it was up the lawyers and judge on this one.

How is there not some sort of massive fine associated with the sentence? F*ck these f*cking people in their f*cking eye sockets.

30 days in jail.

And where is the original homeowner now? Did they give him back his house? I assume not. GAH.

Cold_Sassy 2009-11-24 01:56:07 PM
30 days? That's sickening. Cheating some poor old sick man out of his life's accumulation of wealth is pretty stinking low.

They should have received a much harsher punishment. It's a joke.

Even a nationally televised reaming from Judge Judy would've been a better sentence...

I am a little confused how this is possible...

FTA:
Earlier this year Gilmore pleaded guilty to two counts of second-degree grand larceny as a hate crime and was sentenced to two to six years in prison.

Do you have to be wearing your Klan robes while doing the stealing? Or is this something I have to worry about when stealing from people outside my race, cause that would be a biatch.

MysticSavage 2009-11-24 02:00:22 PM
I think these people should be given the "Man On Fire" or "Law Abiding Citizen" treatment.

mister aj 2009-11-24 02:00:27 PM
The kind of sentencing given out by the justice these days is ridiculous. In my opinion, we've got the technology to make it far more democratic now.

Sentencing could be determined by an online poll, with Farkers and similarly interested internet users voting for anything from probation, to jail to the death penalty. The poll could be presented alongside a short summary of the case and what specific acts the convicted was guilty of. There would be no need to include any detailed circumstances or mitigating factors, as these are irrelevant to sentencing.

airsupport 2009-11-24 02:00:27 PM
Just imagine how many times they had to look into the eyes of this harmless old man and lie outright to him, knowing full well what they were doing.

You have to bury your humanity real deep to do something like that.

30 days and a speech? What bullshiat.

They need to be tarred and feathered, and then taken to a small mexican kid's birthday party to play the role of the pinata.

Jakamo [TotalFark] 2009-11-24 02:05:05 PM
According to the article the foreclosure went through. The old guy lost his house.
30 days (15 or less with good behavior) is about 5 years and 350 days too short. They should be compelled to pay restitution and damages as well.
TFA mentions Gilmore plead guilty to a hate crime. There's no mention of how that factors in, but he got extra time for that. Not enough, but at least it's something.
I hate these people.

It's not that hard. They cover this in the first year of law school.

I'm thinking the protected class in this case would be two-fold: the elderly AND the disabled. How in the world did they get convicted of a hate crime and sentenced to 30 days? What would they have gotten if they didn't tack on "hate crime?" Time served?

I'll do 30 days in a corrections facility for $200k. Handle all of my debt, new car, the works. And you know it won't be pelican bay, it's going to me a minimum security deal with a temporary populace.
