FTFA...The city of Charleston is considering reimbursing a Kanawha City couple for refuse crews hauling away a brand new Maytag dryer that was sitting next to the couple's home, about 70 feet from the nearest trash bin.

The Harrisons called the city and asked for their old washing machine to be hauled away.

They carried that old washing machine out to their curb on Beverly Drive and waited more than three weeks for the city crew to come and take it away, Harrison said Tuesday.



Yeah, 70 feet is right next to the washer they asked the city to pick up.

15 years ago I came home from work and found Sears had delivered a brand new washer and dryer (my garage door was open) while we were out. Anyhow, since I didn't order the thing (they had the right address in the wrong farking city on the invoice) I called them to come and get the damn thing out of my parking spot. After three calls, and each time they promised to pick it up the next day, I gave up. I kept them for about two months then sold them still in the box for $500.

I never heard another word from Sears, saw a bill, or anything.

FTA...Matthew said he had just unloaded the new dryer from the truck and then went looking for someone to help him carry the machine into the basement. When he came back, both the new dryer and the old washer were nowhere to be found.

"I had just unloaded it. I can't believe they took it," he said.

According to an affidavit sworn by Donnyell Harrison, "The washer to be hauled away was right beside the trash bin and the dryer that was taken was new and about 70 (feet) away, sitting on a concrete pad."

If a box of stuff shows up at your house, legally you can interpret it as a gift. This is done so company's cant send you stuff that says "if you want this, keep it we will bill you latter", unless your part of a dvd/book club

Citation please. I think that may not be entirely true, but I'm going to find out.

I had a neighbor who kept several pieces of my mail the alcoholic mail carrier placed in his box, including a couple of gift cards, which he used. This happened around christmas and the cards were gifts from family, and they were upset that I never called to thank them, so that's how I knew they went walk about, and we had receipts for the cards. I reported that I never got the cards, but the stores involved said they had been used. The purchases were traced back to the neighbor, who had the items delivered to his home. The police and postal authorities got involved, and I was told that you have an obligation to return mis-delivered mail back to the post office, or to the addressee.

This was several years ago, and since then I do not have any mail delivered to my home. I use a PO box. Much safer, especially if you get checks and other valuable and personal items delivered via the USPS.

You're confusing this with a different law. Any item a person mails you unsolicited is yours to keep. (e.g. free samples of shampoo). Anything the post office delivers to the wrong place should be returned to the post office for redelivery.

The other law started when companies started mailing packages to people, and then demanding either payment, or return post of the item. Since the items were often heavy, in postal terms, returning sometimes cost almost as much as the price of the item, so it was easier for the customer to just pay them off. This led to a deluge of parcels of random objects being sent to Americans along with a bill demanding payment, leading to congress to pass a law banning this practice; if anyone sends you something you didn't order, they cannot go on to demand payment.

I thought if you opened something that didn't have your name on it would be considered an offense. Hence the Bob Smith or Current Resident. If it doesn't say my name or Current Resident, I don't open it, I just place it back in the mail box and write on the item/letter does not live here and put the flag up.

The "you get to keep the stuff you didn't order" law was to stop companies from delivering things and then sending a bill for things that the customer never wanted. It is still a valid US law but there are lots of conditions that have to be satisfied before its true like the address has to be addressed to you and it can't be a mistake.

Hell I have left an old lawn mower outside my garage and it was gone in less than 15 minutes. Was not picked up by the trash people but picked up by some guy in a pickup collecting junk for the money at the scrap yard. So I would not be surprised if that got hauled by someone wanting the metal for cash.
