Really? I never would have guessed that this guy had psychological issues!

In the suit, the San Jose, California, gamer takes exception to a recent Nintendo Wii system update that disables access to unauthorized third-party programs like the Homebrew Channel.

The HBC webpage says 'do not update' retard. If this guy is intelligent enough to install the HBC, he's intelligent enough to read the warnings.

I am very tempted to call shenanigans without a case number. That sentence that Forty-Two quotes above is too perfectly stereotypical for me to believe.

HBC nothing. The farking update notice from Nintendo themselves says it might disable your wii if you update with a hacked Wii. It even gives you instructions on how to stop updating in case this is a problem. Every time.
I'm amazed they even bothered, and they still get sued. Retarded.

FTFA

"Specifically, the plaintiff is upset about losing the ability to use a program that would unlock the character Rosalina in Mario Kart Wii. Ordinarily, a player would need to have a Super Mario Galaxy save file on the system in order to unlock that character."

Or you could just play the game for a little while. You don't have to have Super Mario Galaxy to get her. Getting a one star ranking on all the mirror courses is a piece of cake.

My happiness is when I am without pants, does this mean I can sue the Denny's down the street for kicking me out last Tuesday?

I don't know how he can sue Nintendo for removing the functionality of a program that violated USC Title 17 Section 1201(a)(1)(A).

I will admit that I would be pissed if I had an Xbox 360 and had to pay $100 to fix a problem that their poor quality control has allowed to happen. But then again, I'm not dumb enough to say "That red ring of death would never happen to my game console, I'll take a 360!" I've done enough repairs on 360s to know that A)the repairs don't last, and B)your Xbox 360 will eventually fail.

The best thing that can be done to fix this problem is a thicker wafer board for the 360's motherboard (it's actually too thin and many problems result from the board warping). Improved cooling might also help out.

in a landscape 2009-11-21 04:16:06 PM
Players must agree with Micorsoft and Nintendo's terms and conditions before playing games online. By agreeing with terms and conditions, you have essentiall signed an e-contract, upholdable in a court. If you violate the disclosed terms, you'll be banned. This case will be thrown out real quick.

Still, that makes this article even MORE useless, because its reporting a non-event.

Microsoft has a 3-year warranty for hardware malfunctions. I had a Red Ring and I was 2 years into my warranty, and Microsoft sent me a box (to send my xbox in), and paid for postage. When my console was shipped back, two weeks later, it came with a 1-Month Live Card, for my troubles.

Microsoft not only fixed the problem for free, but gave me a month of Live to compensate, I'd say that's a good warranty policy.

If the man in the article has to pay to get his system fixed, he has obviously either voided his warranty (by opening up the console) or owned it greater than 3 years.

To refer to my previous post, this case will get thrown out again. Either the article was poorly written, or the man is complete idiot, in addition to his cocktail of personality problems.

Manufacturer Neo Geo repair, only 4 layers internally, boards were thick enough and still got failures, mainly power supply issues zonking out RAM chips. Didnt know tyhe 360 board was too thin causing warpage. New one on me!

You can also extend that three years out to six for $30, which I did before they went from 90 days to 3 years.

I am aware that electronics will eventually fail. I got two Gameboys the Christmas after they first came out within 2 years their screens were starting to die (amazingly, 9 years after I got those bastards they were mostly working. Screens were still in piss poor condition, but good enough to actually plug a Pokemon game into and trade pokemom back and forth from Red and Blue). My first two laptops are in multiple pieces in my workshop area (going to take the parts from the DVD-R drive from one of the laptops to make a green laser). But there is a difference between "This product has a design flaw that we know about and will try to fix." and "This product has a design flaw, we'll send you a new console if it fails but we have no interest in actually fixing the problem."

The warping motherboard only causes a problem if it warps downward, causing a 0022 error which really can't be fixed. If it warps upward there is no problem. Still, a fix that can be made by making the motherboard a bit thicker.

Someone also told me that another problem the 360 has is that Microsoft took the basic Xbox motherboard and added more shiat to it to make the 360 (the same approach they take to make the new version of Windows each time). Not having messed with a Xbox motherboard, not having seen one and knowing the stance that guy had against Microsoft to being with, I'm not really sure that's fact or just a joke a Microsoft. If true, then there might actually be too much shiat on the motherboard causing the warping.

I've had 2 xbox 360's fail due to red rings and both were replaced at no charge and both replacements came with a free month of xbox live. The second time I experienced a failure I sent it off and bought another new unit. So now I have two.
Because I am a pitiful GTA IV addict.

I solved any issues of overheating by placing my 360 on a $.50 cookie cooling rack.

Dog carcass in alley this morning, tire tread on burst stomach. This city is afraid of me. I have seen its true face. The streets are extended gutters and the gutters are full of blood and when the drains finally scab over, all the vermin will drown. The accumulated filth of all their sex and murder will foam up about their waists and all the whores and politicians will look up and shout "Save us!"... and I'll look down and whisper "No." They had a choice, all of them. They could have followed in the footsteps of good men like my father or President Truman. Decent men who believed in a day's work for a day's pay. Instead they followed the droppings of lechers and communists and didn't realize that the trail led over a precipice until it was too late. Don't tell me they didn't have a choice. Now the whole world stands on the brink, staring down into bloody Hell, all those liberals and intellectuals and smooth-talkers... and all of a sudden nobody can think of anything to say.

Not likely, the 360 is a completely different architecture where the XBox is a PC in a different box.

Ouch, if they did retrofits to the original motherboard, a double oven cycle for parts installation would be a fun and warping mess. Come to think of it, too many in a design may achieve the same effect. Your BGAs have different heat conduction compared to passives during the oven cycle, so that can be pulling things all over the place, kind of like Saran wrap and 20 different hands pulling.

While I don't think it is exactly a criminal offense, I do believe it may be a civil offense. Take, for example, Orly Taits (or whatever the fark her name is) getting slammed with a $20k fine for filing frivolous lawsuits. The courts are getting sick of this shiat, and with good cause.

This is just very stupid. As said before, you are not forced to update as you can bail out of an update in the farking warning before you start the update. Also, HBC gets updated soon after a Wii update.

Also, as said, you don't NEED Galaxy for Rosalina, though I woulda unlocked Daisy (Get first on Special 150cc) well before Rosalina. The Prima guide does purpote that items also get time unlocked, but all of the earlier time unlocks I already unlocked as they have stupidly easy normal unlocks (I already have 50cc starred off, but any racing game fan can easily achieve that. I am almost done starring off 100cc.)
