A 12-YEAR-OLD Aboriginal boy has been charged with receiving a 70 cent Freddo Frog chocolate allegedly stolen from a from a supermarket in regional Western Australia.

Oh, he's black. That explains it.

There should be a cut off where it isn't worth the cost to prosecute, and force the people to seek private damages. 70 cents shouldn't be anything.

Children are getting into crime younger and younger these days. I say we up the penalties for crimes. This incident probably deserves at least 3-5, and if he should ever be the recipient of stolen property as valuable as a Big Mac, then I think 30 years of hard labor is appropriate.

On the east side of australia, shoplifting is left off with a caution. I know the state of Western Australia has a 3 strike policy, but I wasn't aware that a single offence carried any prosecution.

Absolutely farked if it is the case. It's likely to have a negative effect and create criminals.

Really? That's the direction you want to take it? In the U.S. courts what he did would constitute a class C misdemeanor and if found guilty his parents would be fined. I'm willing to bet Australian courts would impose a similar punishment. For a kid that young who, as the article points out, has had prior run-ins with the police, this might be just the thing to teach him and his parents a lesson.

In and out, it's a revolving door system. Send the kid into the "Gladiator Academy" for a few hours, he picks up new tips, techniques and connections, and before you know it, he's back on the street, but now twice as saavy in the ways of spitballs and truancy, not to mention at an even greater risk of falling into a life of candy and soda abuse.

They should have locked him up for life.

A WA police spokesman said it's appropriate to have the court deal with the boy, because police have been forced to speak to him about other matters previously.

Fairfax newspapers say the boy has no prior convictions.

If the receiver has a reasonable expectation that the goods he is receiving are legit, such as being handed out by someone dressed as a product spokesman, then he will not be charged. This is why you can purchase things from a pawn shop, despite the fact that such stores are usually repositories for stolen material.

If the goods are received under questionable circumstances, such as buying perfume out of the trunk of a car in the parking lot of a grocery store, you could be charged with receiving stolen goods if the cops determine that the seller stole the items.

Back in the 1940s, a small town Mayor-Judge had the predicament of a dentist whose two small red-headed boys were on a perpetual rampage. Whenever one of the town's two police officers would arrest them, however, their daddy would show up in court with his lawyer, and have them released to the juvenile judge one town over who immediately let them go, over and over again.

So you should be able to explain how this kid being charged with theft is a violation of his civil rights. You haven't done that yet.
