It's the new myth of the potential of distribution. It's the core of the issue with the RIAA's actions, too.

Possession is no longer just possession, it's possession with intent to distribute to thousands if not millions of others. As such, you will be charged as if you had succeeded in distributing it to those people, regardless of whether any evidence exists as to whether you were distributing it at all. 200 years for possession of child porn as opposed to what, 20, maybe, for actually raping a child? Compare that to the hundreds of thousands that woman is fined for I think it was 24 songs, and how much she'd have had to pay if she just shoplifted two CDs. Or even 24, one for each song.

If we apply this to drug cases, a dime bag means you're not just a user, it means you're a dealer. Obviously, that doesn't happen, yet they treat these magic cases differently.

If anything, it's far MORE draconian and horrible than the War on Drugs.

fortunately i'm too busy and lazy to have done it. but i could cause im a programmerdude and actually that would be pretty easy.

I just don't get this country sometimes, but to be clear If i went and raped and killed a child, i would get the same punishment as if I downloaded 20 pictures of naked children
(death penalty not withstanding)? so..

great... my roommates aren't very smart when it comes to safe (common sense) surfing, so i should probably scan/rescan their computers for shiat. no way I'M going to jail for crap downloaded on our IP.

I'm not sure why this is such a huge problem. Doesn't it seem as though the authorities are so focused on who has the porn on their computer, they're failing to capture the people that created the porn in the first place? Who are the people that are making the porn, and who would be so stupid to try to find child porn online in the first place? It would take a true buffoon to actually look for it. It would seem safer to make your own nowadays...BUT DON'T DO THAT!

Think it shows the police don't care if you are innocent or not - they just want to look at all the child porn with the excuse of having someone under arrest. Can't exactly arrest a virus... so, it is off to the evidence room with a flash drive and a box of tissue.

Personally I'd rather have a rapist of any kind visit sites like Society BDSM than actually go out and rape a person. Same can be said for pedos. Not the best solution, but in this case it's a question of harm reduction.

Was not an average person it was his companies IT dept.

Scanning for porn is a standard It hobby when a system comes in.

Seriously never have anything remotely embarrassing on your work system or they will find it, copy it and may report you to management.
