Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain "acceptable health insurance coverage" and who choose not to pay the bill's new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

In response to the JCT letter, Camp said: "This is the ultimate example of the Democrats' command-and-control style of governing - buy what we tell you or go to jail. It is outrageous and it should be stopped immediately."

Key excerpts from the JCT letter appear below:

"H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax." [page 1]

"If the government determines that the taxpayer's unpaid tax liability results from willful behavior, the following penalties could apply..." [page 2]

"Criminal penalties

Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7203 - misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 - felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years." [page 3]

When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.

"The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi's decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare," said Camp.

According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker's bill would cost $15,000 in 2016.

This. I do not have nor do I want health insurance. I've only needed to see a doctor once in the last 20 years and that was for a short lived bout with clinical depression that I'm now cured of. Having to buy health insurance would be a waste for me. A time may come when I'll need it, but I'm a grown adult, not a child, I'm perfectly capable of deciding when I need health insurance. Some would say things along the lines of "what if you suddenly get hurt or sick?" Yeah, there is that possibility, but I'd rather take my chances, however foolish that may seem. My point is that I DON'T WANT IT FORCED ON ME!

I agree, also the 40 hour workweek has to go. Why limit the freedom of people to 40 hours of work before penalizing employers? People are calling for their freedom back. America wants to work honest days of however many hours their respectable employers wish, with no PENALTY for success.

If you have a heart attack and get 500,000 in debt, go bankrupt, and can't afford to pay that back, do you know who has to? Yes, all of us, which has put us in this clusterfark of a situation. Single-payer would be ideal, but until that time comes around, quit being such a farking hazard to society. Oh, but Obama and Democrats are the bad guys! They're actually not words from the bill. As I posted in another forum to somebody who was using the exact same talking points as you:

Of course, then CDglassa looked at the actual text of the bill and found that the amendments to the Internal Revenue Code begin on page 296. He read through the section and found that it indeed starts with the implementation of a new 2.5% tax for some people. Reading further, he found that the tax does not apply to several groups of persons, including those with religious objections (VIII.A.c.5, pages 299 to 300 of the tabled bill.)

He determined that the penalties mentioned in the JCT letter are standard penalties that apply to anybody who doesn't pay his or her federal income tax, and have been around for quite some time.

He then went on to read what "acceptable coverage" meant, as per VIII.A.d.2:

- Any public option plans (VIII.A.d.2.A.)
- Any previous insurance or employer-based insurance (VIII.A.d.2.B.)
- Medicare or Medicaid membership (VIII.A.d.2.C and VIII.A.d.2.D.)
- Armed Forces coverage or VA coverage (VIII.A.d.2.E and VIII.A.d.2.F.)
- Any person who has Indian status and has medical coverage stemming from that (VIII.A.d.2.G.)
- Any person who has any other form of medical coverage (VIII.A.d.2.H.)

Since several of these categories cost less than $15,000 per year or were even free, such as Medicaid or VA coverage, it left CDglassa wondering: who exactly was not covered by any of those categories, and for the love of god why not?
