I think they timed it out brilliantly. They let the auction run up to 40k, got all the La-Z-Boy press they got from that, and then they pulled the plug and are getting all the publicity AGAIN. Obviously, they felt the same way about the infringement the entire time, but they waited until the initial buzz was dying down and then threw another cup of gas on the fire (to ruthlessly mix metaphors). Genius, really.

I remember something about this in the 5th amendment...

it doesn't just make sense.. it is actually the law

a trademark that isn't defended is considered abandoned and is no longer enforceable.

Must have something to do with the definition of "public use".

If it's taken because you used it in the commission of a crime, and said property is sold to cover damages, is that "public use"?

Yeah, Subby, just like escalators are free advertising for the Otis Elevator Company, and yo-yos are free advertising for Duncan, and kerosene is free advertising for Gesner. Oh, wait, those trademarks all went generic.

One thing that gets me about Fark is that not only are there a bunch of idiots who think you have to enforce your copyright or patents or you lose them, the same bunch of idiots think you don't have to enforce a trademark.

It was an unlicensed vehicle used in the commission of a crime. The drunk probably can't prove it was his so it was seized until the rightful owner shows up with proof of purchase for the chair, the engine and the cool steering wheel. Since no one can come forth, the cops get it.

Maybe they took it for use and benefit of the police force, rather than the public.
