Prosecutors say Daniel Weston and Mary Ann Parmelee hired two loan modification agents in hopes of keeping their home but believed the men took their money and did nothing.

hmm...well, first off a lot of those loan modification people ARE scammers. That said, if these two guys turn out to be actually BE scamming people, then the perps are gonna walk.

I think the chances for jury nullification on this are pretty slim.
We're talking torture here... a DA can have a field day playing upon the sympathy of the jury for the heinous ordeal those two guys went through. Regardless of just what scumbag bottom-feeders they really are.

Besides, if they were frauds, there are civil courts to take such matters to.
Luring someone under false pretenses so you can kidnap, torture and rob them is taking things just a wee step to far.
