Do you really "carve" your name in wet cement? Isn't it more like using a stick to draw it. If he did in fact "carve" his name in the cement when it was dry, then by all means he deserves to take it, because man, you are doing it wrong.

How awesome would it be to live in a world where if you wanted something you just took it and paid off anyone who had a problem with it?
Further, how awesome would it be to not only have the kind of money to pull that off, but the kind of money where shiat like that actually occurs to you? Like, for me I would just think: Man... I wish I could afford to buy my childhood home. For him: I am buying my childhood home, moving it to my property and then going and cutting out a 3x5 slab of concrete from my grandma's old house and put that farker in my driveway because I want to.

Man. They say money can't buy happiness - but it definitely pays the farking bills so you can worry about other stuff.

Pickens has screwed a lot of people over, especially in the area of his pet university in Oklahoma where he's literally had people forced out of their homes by eminent domain trickery (the fact that he can control the actions of the local government/university enough to force eminent domain seizures being an entire other chapter in the story of his pissing people off). There are reasons people, especially in OK, will go out of their way to inconvenience him at times. Plus,

It says in the article it was city property, you can't pay a guy for city property.

If he stole anything it was probably from the city, which would probably not have let you buy the slab anyway.

Better to pilfer the slab, fix it (it says the sidewalk was repoured and fixed) then deal with any consequences. The worst they are going to do is make you pay more money to do a better fixing job

From the article:

Ken Chestnut, an attorney for the city, said he's not sure if anyone sought permission to remove the slab. But it's "a private matter between the parties" and the city does not need to get involved, Chestnut said.

It is only technically city property because it is near the street, and the re-pouring cracked his driveway. It is a private matter, and it is irrelevant how wealthy Mr. Pickens is. You don't go to someone's house and rip up their driveway because it has sentimental value to you.

Considering the amount of damage he apparently caused illegally fetching his boyhood slab and arrogantly ignoring property rights or even common courtesy, throwing the book at him as an example that no one is above the law might be a good idea here.

Gamer Grrrl [TotalFark] 2009-07-14 05:49:36 PM
So Pickens admits that he has the slab now, so it's very likely he did in fact steal it. I can see where the plaintiff is coming from on this one. Pickens clearly believes in the "better to ask forgiveness than permission" theory.

On a slightly related topic, a church down the street from my house installed a low brick retaining wall when I was a kid. The concrete blocks were filled in (vertically) with cement, and the wet cement was accessible at the top. My neighbor from three doors down wrote my name in the cement, one letter in each block, about three times. My name is Keri, and when I was a kid, I was the only Keri around. Also, the church was less than a block away. Fortunately, I was never accused of anything, but every time I'm visiting my parents and I walk past the cement blocks I think of Shane Eberle, the kid who did it.

dragonchild 2009-07-14 05:49:39 PM
Uh, too bad for those hoping for a warm fuzzy ending, but 3'x5' is a pretty big piece of concrete. Drop a car's wheel in there and it can cause a fair amount of damage. And he just took it?

The guy who owns the property contends that it's his. The city says it was on the right-of-way, their property. Either way, he's going to be paying someone a settlement. The charges will never make it to court.

All the more reason to bring criminal charges. If I hacked off a piece of somebody's driveway and ran off with it, I'd be cooling my heels in jail, waiting to see what charges the DA decided to drop on me. This guy hasn't even thought about that, and the idea of pressing charges seems outright foreign to the authorities in this case. The mere fact that the homeowner's only method of obtaining justice is going to be pursuing a hopeless civil suit against lawyers that wipe their ass with more money than he is worth should disgust anyone with a pulse.

Exactly. Farkers assuming that Pickens should have negotiated with the rightful owner are nuts. If the owner had something some rich farker wanted very badly, the dude would have asked for a crazy amount of money ($1 Million?, $10 Million ?) or just had the smug satisfaction of saying no to some jackass billionaire.

My take on it. Privileged impunity needs to be sharply curbed.

By the way, the spines on the city's attorney and the police chief need to be stiffened. In the article, the spokesman for Pickens all but said "sweep this under the rug and I'll slip you some 'historical monument money' for good measure."

That kind of palm-greasing arrogance needs to end.

eqtworld: Come on... don't be melodramatic

Melodrama would be claiming that Pickens lowered the value of his property by stealing a piece of history and asking for tens of thousands (the difference between owning a historical site and owning a house.)

No, Pickens needs to be somehow slapped for acting like a jackass - that's not melodrama. That's simple justice.

wmoonfox 2009-07-14 06:16:37 PM
eqtworld: It was technically city property, and the piece of removed concrete was immediately repoured.

Irrelevant. If you steal my truck... or, let's say, to use your example, my tree, and replace it with a duplicate, you have still stolen from me. The fact that the property likely belongs to the city makes it even worse, as a failure to prosecute would indicate a bias on the part of city officials.

The fact of the matter is if you, I, or anyone had no criminal record and "stole" a piece of concrete we defaced 70 years ago (which had never been fixed or prosecuted because such things are not a big deal) and tried to patch up the sidewalk the best we could...

The court would be lenient and at worst would make us pay for a better patch job.

Thirty years ago, maybe... not in this day and age. People go out of their way to avoid the appearance of impropriety at every turn. They only make exceptions for the elderly or the rich, both of which this guy has going for him. If you or I did it, especially if we announced it proudly to the world, we would be in jail -- no questions asked.

I thought of that, but he was a manipulative and cunning little booger. The first time I was ever at his house (we were 5), he said, 'Keri, chase after me while I ride around on my bigwheel" and I did because he was my new friend. His dog German Shepherd Boomer was a trained guard dog, but I didn't know that. Boomer thought I was attacking Shane, and bit me on the leg. Shane got spanked, in front of me, because he knew Boomer would "defend" him.

I would not be surprised if Shane really wanted to vandalize the wall but knew if he wrote 'Shane' he'd get in trouble. So he wrote my name instead.

Something tells me "David McCart, who bought the two-story, 17-room home in Holdenville nearly 20 years ago - partly because of Pickens' signature -..." is more then partly and more likely what we aren't hearing is the guy had previously tried to high-ball the price to Pickens knowing he was in the mood for wanting childhood nostalgia. Still doesn't given Pickens the right to just steal a hunk of the guy's drive way but I think there is douchery on both sides of this feud.

Anyone else reminded of the Simpsons episode where Mr. Burns wants his Teddy Bear back from Maggie?

Seriously, though - money can't buy class, I guess. I suspect the reason Pickins didn't just contact the owner and ask permission is that he figured the owner would demand an extortionate sum for the privilege, seeing with whom he was dealing. But really, tough titties, Jed Clampet. Pay the man, if you're so attached to it.

This thieving bastard lowlife billionare is more than willing to drain the Ogalla aquifer in order to further deepen his pockets. And under Texas law and right of capture, can do so.

He has built an amazing ranch on his Mesa Vista Ranch on state highway 70 and the Canadian River. My sil works for a guy building the ponds and rivers and watering the landscaping.

Pickens' attempt to take over the Phillips Petroleum Company cost long time stock holders (ie employees and former employess) a small fortune.

He has this grandiose scheme to build a windmill farm but has put that on hold due to the economy. First of all, look at the environmental damage such a farm would bring about. Would Pickens put the mills on his 68K + ranch? "Hell no, the damn things are ugly". And they are. Is wind power a real choice? No. Investigate the government subsidies, the loss of power in transmission, etc. Wind power is a joke. Put a nuclear power plant up.

And finally, as my diatribe comes to an end, if you can jail this old bastard for anything, find it and do it.

And for all the tinhat farkers, Dick Chenny is his hunting buddy and regularly flies in for out of season hunting and butt sechs.

My guess, it would not be the slab with the name on it.

He said in the article he doesn't really care about that little chunk of concrete... he does, however, care that someone just REMOVED A LARGE CHUNK OF HIS DRIVEWAY without asking or even telling him.

It's about Pickens not caring about the guy who owns the house now. There was absolutely zero consideration for the other human being.

It looks like someone on his 'construction' team may have just said, "hey... this could be wrong".

Nah. Money buys out logical thought.

If I was in charge there'd be a special law on the books for rich farks who think they can do anything they want. It'd be whatever the existing penalty for the crime is times one million. That way, arrogant, thoughtless crap like this would be more than an afternoon's work for a $600 an hour lawyer.

No, they'll still just pay the fine, or find some other way around it. Jail time is the answer. 90 days in the slammer, the same slammer any other burgler would get. At 81, 90 days behind bars means something. Remember, Paris Hilton could pay any fine with impunity, but common-joe jail time was a whole different ballgame.

Then you fine them the replacement costs for good measure.

Treygreen13: eqtworld: Treygreen13: Instead, he just sent out a crew and lifted a huge chunk out of somebody's driveway. Fark him.

Evidence would suggest otherwise.

I have to be honest, at least someone is here, I have a fair bit of money now. I don't have anywhere NEAR that much, there is a point to this...

If I had his kind of money? You're right, I'd be a total asshat too. 81 years old? That's not that far away really for me. I've already reached the point where I'm old enough to not really have the patience to deal with a lot of things.

If I had his sort of stack of cash I'd likely be a prick too.

I'm not an Okie lawyer (thank God), but I'm thinking that chunk of concrete is worth more than $500, and that Mr. Pickens and his accomplices should see jail time. The optional fines in lieu of jail time are clearly an insufficient deterrent here.

This guy hasn't even thought about that, and the idea of pressing charges seems outright foreign to the authorities in this case

You'd be facing several (newly inscribed) felony theft charges, and possibly some terrorist charges as well. The city would suddenly be quite happy to charge and prosecute to the max since you're not a billionaire who could bankrupt them in court.
You would be forced to plead guilty for fear of losing and getting 25 years so the prosecutor can keep his win stats and you'd get, depending on the judge, 1-3 years. Plus a large fine you'll be paying for the next 30 years.

That's why it's good to be rich and while I'm getting that lottery ticket tonight. I have a feeling I'm going to win...

Pickens donates a lot of money to a lot of places--likely to that city out of pure sentiment. If you, the city, find that a wealthy benefactor has relieved you of a small portion of sidewalk with only sentimental value--and repaired the damage at his own expense--how likely are you to bring charges upon him. I can tell you that the city attorney who decided to pursue legal action against Pickens on this would find himself on the outs with much of the city leaders.

Yes stealing is wrong, but why risk turning Pickens into an enemy?

My advice to the homeowner would be to create a tongue-in-cheek plaque honoring the location of the theft and it's former contents.

1) In an action for conversion (technically a replevin action) you can get the object back if it is unique. I believe this qualifies.

If Mr. Pickens ignores the order of the court for replevin he is in contempt of court and will be arrested. Just like anyone else.

2) In an action for real property you get attorney fees paid for. This is for damage to real property, so yay.

3) I'm sure the property owner was being unreasonable in his asking price when T-Boone wanted to buy it. As is his right. Used to getting his way T-Boone just took what he really wanted.

I'm glad I live in a land where people with greater means than I can take whatever I have whenever they like without the fear of prosecution that we lesser folks have -- just like every other place on the planet. It helps me realize that we're all not so different from each other after all.

Its a 3 x 5 concrete block.

If any of us normal folks had gotten caught stealing it we'd pay restitution and that'd be the end of it.

Because he's worth billions he's being sued.

Liberally1337: Pickens donates a lot of money to a lot of places--likely to that city out of pure sentiment.

My advice to the homeowner would be to create a tongue-in-cheek plaque honoring the location of the theft and it's former contents.

you can bet that any money he donates is going to lessen his tax burden some how

the guys is s prick for doing this

hey and TBoon ... grow the fark up already it's just a piece of cement and that whole sentimental value thing .. transcend allready holy mercy you are a grown assed man

greaser_77: T-Luv: Neutral field. OU lost

/And they lost their bowl game so... Back to the topic at hand?

Count the number of football national championships UT has. Now count OU's, so... Back to the topic at hand?

And how many of those were the result of cheating?
Face it, the entire mythology of your state is built on the foundation of cheating.

Gamer Grrrl: MajorityWhip: Gamer Grrrl: So Pickens admits that he has the slab now, so it's very likely he did in fact steal it.

Sounds like Shane was sweet on you

/Shane got spanked in front of me A LOT
//Spanking isn't always the solution folks. Perhaps you should try something else?
///That always made me uncomfortable
////I'm pretty sure Shane was an accident since his siblings were at least 10 years older than him.
//Slashies!!!

I think you missed the underlying point that Shane liked being spanked in front of you.
