The main problem with panicking and leaving the scene is, how do we know the victim would have died if she recieved immediate medical treatment?

Well, see, the problem with your statement is that this article is in the business section, not opinion. See, the New York Times categorizes their articles into neat little subsections so that educated readers can discern what should be considered reporting on facts and what should be considered opinion.

So go back, read the article, and tell me where this author (and respected economist who teaches at Harvard and has his PhD from MIT) is injecting opinion into the article and not backing his statements as fact.

If this were an op-ed, it would be in Opinion, with the tagline of Op-Ed Columnist. But since it's in business, we can probably safely assume that it is not an op-ed piece.

but the writer isn't a politican. Quick wiki of him says that he went to Princeton undergrad and got his PhD in Econ from MIT and spent some time at Harvard Law. The fact that he's a Keynesian means he is slightly left of center as far as economists go. Partisan hack.

Would you still have sympathy for her or is it the fact she hit a homeless person that makes you say she shouldn't get any level of book thrown at her?

the fact that none of us are related to the victim makes us more suited to talk about what punishment she should get since there are no emotions getting in the way. She definitely deserves punishment but her crime is still only leaving the scene of a fatality. She didn't cover anything up, either. She didn't get her car fixed.

You should check your insurance policy's contract... Don't think they can legally "drop" you right when you need the insurance payout... there is probably a clause against that. Yes, no doubt you may have lost your coverage from said company, but there are others. Also... How did the judge/police/insurance company even come to the conclusion that a paint scratch on a bumper was worth 45k? Or did he claim emotional damages too?

Sounds like you need a lawyer that is as good as your insurance company.

That blog really makes me want to post a comment to "Taylor" who was a family member of the homeless woman. Apparently she is upset now, but had the family taken care of this woman, she would not have been on the street...and jaywalking.

So who's fault is it really??


I don't think the girl should get in trouble for hitting the jaywalker, but she SHOULD get in trouble for leaving. More so because there was a death involved.

But to blame the family of a victim of an accident??? That's low. If homeless, she was probably mentally ill. If she's mentally ill, she's gonna do whatever the fark she wants until she's killed or put into jail/instiutionalized for her actions. As we know, she was never put into jail (or maybe just not long enough).

"Driving like a teenager" means driving carelessly. Drive by any high school or freshman dorm around school hours and you'll see any number of young drivers texting while driving, turning to talk to people in the back seat, and whatever other stupid bullshiat they do. Any of them could potentially hurt or kill someone while not paying attention, most of them just aren't unlucky enough to do so.

Maybe, maybe not. Whether it is more or less I don't know, but probably a significant number do. People make bad decisions when they freak out, just like she did.
How many people do you suppose flee the scene after hitting someone and NOT killing them? I don't know, but I'd guess lots, and any of those people could have ended up like this with some bad luck. It's just that not too many of those sorts of stories make national news unless the victim dies (and most of those are just local news, too).

That blog really makes me want to post a comment to "Taylor" who was a family member of the homeless woman. Apparently she is upset now, but had the family taken care of this woman, she would not have been on the street...and jaywalking.

I don't think the girl should get in trouble for hitting the jaywalker, but she SHOULD get in trouble for leaving. More so because there was a death involved.

But to blame the family of a victim of an accident??? That's low. If homeless, she was probably mentally ill. If she's mentally ill, she's gonna do whatever the fark she wants until she's killed or put into jail/instiutionalized for her actions. As we know, she was never put into jail (or maybe just not long enough).

agreed. I still think a bunch of hours community service working in a homeless shelter or walking around my apartment topless would serve a much greater good than throwing her in jail

The fappable driver committed a crime as a result of the victim committing an unlawful act. Therefore, the victim should be blamed as none of this would have happened if the homeless lady were not committing the crime.

QFT. If you're going to San Francisco, be sure to look at the tops of the buildings if you want to see any beauty at all. The further you progress downward, the more prevelant the absolute filth. There are more lazy, crazy, drug-addled homeless in San Fran than there are pigeons there.
