PS, car insurance covers the cost of that - 45 days and a $16,000 insurance payout later and the guy that got hit limped away on his crutches. That was his civil suit... The 20 year old had assets my friend www.jdavid.ca (Minas Realties). Of which he did not have to award a % to the guy he hit...again...his insurance covered it - if you had assets you would know about insurance.

I feel sorry for the Americans, can't do or say anything without a lawyer because anyone and everyone can and will take you to the cleaners.

Just curious... what civil suit would the biker in question (in my short anecdote) be able to bring that would award him any extra damages ontop of what was already given?

I was going to post that the deceased was probably mostly at fault for the accident, the driver was a criminal dirtbag for running and then trying to cover it up, and that the fast lane booking was totally irrelevant and probably a good thing over all. I know that specific joke, but the sentiment that homeless people don't deserve the protection of the law, that their lives lack value because they have less, is commonly expressed.

Yes. It's not automatically a crime to hit someone or something with your car, if it's not your fault. People can "jump out" unexpectedly. Leaving the scene is the crime.

Also, it's not even automatic that leaving the scene is a crime if you can prove that you were unaware you hit something. A woman in a van scratched my mirror while I was stopped one day, and kept going. I followed her and got her license, but the cops wouldn't even get involved. They simply gave me her personal info and told me to contact my insurance company.

Thankfully, this is not correct. Jeopardy only attaches when the jury is sworn, so simply dropping an initial charge is of no importance constitutionally. She can certainly be tried and convicted.

Very sad for the victim and her family, but putting a 17-year-old girl in jail for driving like a teenager isn't going to fix anything. She hit someone by accident and freaked out, as many people would. So now you're going to put her in an adult prison for 30 years to... what? Teach her a lesson? What does that teach her, exactly? "Don't act like a teenager"? All you're doing is punishing her for something they didn't mean to do and making sure that she will not be able to do anything useful with her life afterward, none of which will bring the victim back to life nor make her family miss her any less (and yes, homeless people can have families).

The NYT link that Darth Mewling provided was written by N. Gregory Mankiw, the Chairman of President Bush's Council of Economic Advisors.

He also happens to be heavily influenced by Keynes, as are most of Obama's econ advisors, so I am not entirely sure what Wendy's Chili is getting at. Probably guilt by association.

Oh, my lord. Let me tell you a story how a guy, who badly cut me off in traffic and got hit in the back as a result at a speed of 15 mph (!!!) walked away with a 2inch paint scratch (!!!) on his back bumper and 45K of my insurance's money. Oh wait, I think that was the story.

"Driving like a teenager" means killing people? So all teenagers should be allowed one free killing? You're farking retarded.

And while most people might freak out after killing someone, most people would not flee the scene and hope no one cathes them.

Also, it's possible that she fled for a reason, like being under the influence at the time, which would make her no better than any other hit-and-run DUI murderer. And before you make a retarded "she was just drunk driving like a teenager" excuse, if you don't know that drunk driving is illegal and potentially deadly by the age of 17, chances are you're never going to do anything good with your life anyway and should have the book thrown at you.
