1. People in cases who were complete idiots.
2. People who have no idea what it takes to succeed in a defamation or IIED action.

With enough money you can get a very good lawyer to represent your claims no matter how stupid they are.

Subby, after reading TFA, actual malice is provable, even if it is difficult. Lets recount the elements: * knew the statement was false, * published anyway, * intent to harm personally.

So, if I were to just pull something out of my ass and say that a state politician was under federal investigation, without any evidence whatsoever, I very well could be sued for libel.

And remember, it's civil court. Preponderance of evidence (51%).

I dunno, I think it depends on who does the saying. If someone posts something anonymously, it doesn't have much credibility. If you are a known media figure who's blogging and you try to spread vicious rumors that are lies, then you deserve to be sued.
