I don't get this "Sotomayor is not qualified" argument. I guess that means Ginsburg, Souter, Stevens and Breyer are unqualified because they dissented in the case? Coincidentally those are the four more-liberal justices. Wow, what a coincidence.

The SCOTUS is a joke right now anyway. They should just let Kennedy rule and let everybody else take extended vacations. Funny that Kennedy seems to have turned conservative lately given that the right wing has been bashing him for years for being an incompetent dimwit.

Isn't this why we have a justice system with a circuit appeals process, and why we have 9 justices on the supreme court instead of 1 or 2? Notably, the SCOTUS was split itself. This decision will have no bearing on Sotomayor joining the court. Predictably a handful of republican malcontents, I'm thinking Tancredo for one will try to get some political mileage out of this for the douchebags back home but Sotomayor will still cruise through. The embittered irrelevants will stay irrelevant.

Seriously, this in no way makes her unqualified. Harriet Fricking Miers was unqualified. That is the only unqualified nominee I can think of in the last 30 years at least.

Man, it's been forever since I saw or heard that name, and the first thing that popped into my head was the Dan Savage definition of Santorum. That rules. Also kind of gross, but still.

Just because their ruling and their statements after the fact are utterly incompatible is no reason to assume that the liberal justices did it just to run flak for Sotomayor.

Incompetent... hell yeah


Also look for same incompetence is Heller v DC. Letting your ideology force you to an incorrect conclusion is very bad.


How they got 5-4 on these two rulings is very scary for America
