If you read up a little more on this the man "cavorting with a farm animal" is a clip for the man show with some guy getting chased around by a donkey with a 3 foot long erection. also the "personal web site" was a file server for his home network that was not set up right.

From what I read, he basically had a web site set up with a bunch of funny-yet-tasteless pictures on a web site, much the same as any Farker worth her/his salt, which he and his friends would share. The mistake he made was not setting the web server to no-index, so that people could browse all the pictures. Somebody who was pissed at Kozinski became aware of the site, realized they could make a big deal out of it and sent the link to the media.

So basically, he made a naive tech mistake any number of people could have made, but since he's a federal judge it turned into a big stupid brouhaha.

Actually Judge Kozinski is one of the better federal judges. Not as good as he used to be even 10 year ago, but he is more likely to pen a decision in favor of privacy rights than most other federal judges.

I don't know which specific video they are talking about but if I cannot imagine it being worse than the one scene in the Tom Greene movie, Freddy Got Fingered, in which he basically jacks off a horse (which is the point I stopped watching). It not for me, but if the Tom Greene's movie was acceptable (not illegal) material to be shown in theaters across the country than it really shouldn't matter that a judge has it on his computer, or what he thought was a secure portion of his personal website.

The key factor should be whether the content was illegal, not simply in bad taste or offensive to some.

This is such poor and irresponsible journalism. They purposefully tried to make that donkey video sound like bestiality porn, when in fact the guy was attempting to escape from the donkey, not boink it. It's like saying someone 'was in a close physical relationship with someone who was not his wife" based on seeing a man hug his daughter, or saying a kid who was sitting under a tree with a portable video game was "playing with himself in public." Totally inaccurate, biased, and intended to unfairly sway public opinion.

Maybe the journalist in question just happens to enjoy "writing titillating descriptions of men engaged in unseemly acts with animals."

I used to clerk for another chief judge of the Ninth Circuit when Alex was a young judge, so I am really getting a kick out of . . .

Seriously, this was a screwy situation and Alex seems to be capable of extreme carelessness. But Fark is the last place he should be criticized. I don't know if he is a Farker, but if he isn't, he should be.

everyone loves to talk about the ninth circuit being the most overturned by the Supreme Court. However, the Supreme Court usually takes cases to reverse them -- and the Ninth Circuit is by far the biggests of the Courts of Appeal. So, it gets overturned more because it has more cases. Ta Da!!

The ninth circuit is also critized by conservatives for being liberal. The fact is that it has, and has had for decades, extemes. Some very liberal judges, but also many very conservative ones. Kozinski was from the conservative wing, although admittedly he has a strong libertarian streak and is in favor of first amendment rights and has a variety of other views that the so-called conservative movement does not share.

That is all. Rock on, Judge Alex, you crazy coot!!

Federal judges are appointed for life and can practically get away with murder. From what I understand they have to actually be impeached by Congress. They don't have to worry about being reelected, so they can do just about anything, as long as it is not heinous, or illegal.

And for those following at home, this all came up because one litigatious asshat who had a personal vendetta against Judge Kozinski. Seriously, from everything I've read and heard about this judge, he's one of the good guys who's being smeared by a pretentious and self-important twat-waffle.

The judicial panel's report criticized the media for sensationalizing the story and exageratating the amount and nature of the sexual material on the Web site. Oddly, most of the media haven't reported that. In fact, the LA Times which was the main offender just reported that Kozinski was admonished by the panel for a lapse of judgement and never mentioned that they specifically cleared him of aby illegal activity or judicial misconduct.
