Bachmann has said she will answer only certain questions on the 2010 Census form

I will only answer certain questions. It's a common protest. The government has a constitutional need to know how many of me there are (one). It does not have a constitutional need to know the racial mix of my pet tarantulas.

It's good to see that at least some of our GOP leaders understand the concept of the "point of diminishing returns." Clearly Bachmann doesn't.

Canada went through a phase where the conservative party basically collapsed. We had 12 years of majority Liberal party government that sat on their hands - doing nothing. Now, we have minority governments that require elections every ten months but at least there's an attempt at tackling some legislation.

What's the authority for this supposed $5,000 fine?

The online US Code has a $100 fine -- rarely or never enforced -- for refusing to answer. 13 USC 221(a). There is a $5,000 fine -- probably also rarely enforced -- for government workers and contractors who improperly disclose information. 13 USC 214.

abb3w

Refusing to answer the intrusive questions doesn't diminish the census count of residents.

Of course, given Bachmann's proven delusions and sociopathy, this action by these other lawmakers will only drive her to higher levels of drooling insanity and "justify" her belief that ACORN has infiltrated the Census process at the highest levels.

Which, gotta admit, is going to be even more entertaining.

I've said it before, but Bachmann doesn't scare me. What DOES scare me that there are hundreds of thousands of Minnesotans who look deep into her Manson Lamps, listen to her make outrageous statements and say "We need to send that woman back to Washington, D.C. for another term! You betcha!"

I am sick unto death of hearing that the Census is "unconstitutional." The Constitution says that it's up the legislature to determine which questions are on it. They could ask for your blood type, work schedule and a list of your greatest fears and it would STILL be constitutional.

By definition, anything the legislature puts on the Census is constitutional. The only unconstitutional questions would be ones the census taker makes up on the fly. ZAZ, you may have a valid point that the questions are intrusive, but they ARE constitutional. You have NO leg to stand on claiming that they are not.

The Census web site says "This fine is changed by the Sentencing Reform Act of 1984 from $100 to not more than $5,000." The applicable law seems to be 18 USC 3571(b) saying that all federal infractions are punishable by a fine of $5,000. So not answering a census question is treated the same as not wearing a seat belt while driving on federal property. You probably won't get a ticket for it and if you do you probably won't get a $5,000 fine.

What will happen is that eventually the dems will split and instead of having a two party paradigm of "moderate" and "bat shiat crazy right", we will have "somewhat moderate" and "kinda liberal".

If you look at the elected democrats these days, they are a really diverse lot. The only thing that really keeps them together is that the GOP is farking off their rocker. If you take away that pressure on them, then they'd be more than happy to give harry reid/nancy pelosi the finger.

TwistedFark: What will happen is that eventually the dems will split and instead of having a two party paradigm of "moderate" and "bat shiat crazy right", we will have "somewhat moderate" and "kinda liberal".

If you look at the elected democrats these days, they are a really diverse lot. The only thing that really keeps them together is that the GOP is farking off their rocker. If you take away that pressure on them, then they'd be more than happy to give harry reid/nancy pelosi the finger.

See, I'd be down with that. I think that we need a little bit of pie eyed hippy to keep people from being totally evil, but we also need a party that understands how to act decisively and viciously if needed. I could go for a *real* progressive party, and then the Democratic party. I can see myself voting for either of those parties.

But the GOP has pretty much lost me, and my generation, forever.

I'm curious subby...

Why is it retarded not to want to let the government in on:

- the schedule of when you leave your house and when you return

- my ancestry

- my level of education

- if I have difficulty making decisions

- extensive personal income information

- how I get to work

- how much time off from work I took

- details about my house, how many rooms, bathrooms, etc.

- details of my utility bills

- details about my mortgage

...and so on.

I feel that the federal government is really "getting to know me" on an uncomfortable level. Michele Bachmann may be batshiat crazy, but the federal government should really only need to how many human beings inhabit the structure at that address, and leave the rest up to the states or to the citizens' discretion.

Maybe some of you should do some research to see what she's talking about. The census survey is 28 pages, and asks very detailed information that is none of the government's business, and has nothing to do with census requirements. Why would they need to know what time you leave and get home from work? That's one of the questions. Some of you should check facts before attacking someone. Nobody cares how you feel.

"[An] Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct."

That, quite clearly, provides constitutional grounds for any question they wish to place on the census. While it still must operate in the bounds of the 4th & 5th Amendments (they can't ask you about crimes, and they can't prosecute you for your answers (and they can't discriminate against you for your answers under the 14th)), there's a great deal of leeway in there.

Anyone who says they aren't constitutionally obligated to answer every question on the census is a moron. They have the legal power to ask you near anything- and the very first census in 1790 asked questions about all sorts of things, because it was vital, at the time, to evaluate the available labor pool and industrial infrastructure.

Carth: ZAZ: The Census web site says "This fine is changed by the Sentencing Reform Act of 1984 from $100 to not more than $5,000." The applicable law seems to be 18 USC 3571(b) saying that all federal infractions are punishable by a fine of $5,000. So not answering a census question is treated the same as not wearing a seat belt while driving on federal property. You probably won't get a ticket for it and if you do you probably won't get a $5,000 fine.

Most likely nothing will happen. But if enough people decide to "protest" it would be an easy and legal way for the government to make money off other's stupidity. 100,000 people time $5000 each. Half a billion?

We could pump all that money into the economy!! Brilliant!!

I often wonder how many of the people complaining about the census have actually taken the 30 seconds of Googling it took to find the questions that are going to be asked.

The Census Bureau has submitted its questions to Congress, and amazingly enough, they can be found at the Census website.

Or, because I'm a nice guy, you can read the PDF here. (new window)

PS. Also, there is no Long Form survey this year. Instead, the Long form questions are being moved to the American Community Survey which is done every year, but on a much smaller statistical sample.

CrazyCracka420: I guess I'm genuinely curious, does your name get attached to the census? I always sassumed it was "anonymous". If you're names not attached, then where's that irrational fear coming from?

The only way to even approach any type of anonymity, according to one government source, is to not list yourself as head of the household. But you still have to list yourself as living there.

And my fear isn't irrational - it comes from a sense of history, and how and why this country was founded in the first place.

But I realize you youngsters weren't taught much history, and probably no civics in public school...instead you were taught multiculturalism and various "study packets" provided by the United Nations. So you may be unaware that:

More than likely, yes.

Here are three of them:

* Hillary Watch - Get more information about the Hillary Clinton's political, financial and ethical lapses.

* Security and Prosperity Partnership of North America - Get more information about the efforts to integrate the US, Canada and Mexico.

* Gardasil - Get more information about the Judicial Watch's efforts to expose the adverse effects of the Human Papillomavirus vaccine.

So...I'm not going to pay attention to anything they have to say.

In its official statement responding to the ACORN controversy, the Obama Commerce Department downplayed ACORN's participation in the Census, and labeled "baseless" the notion that ACORN would be involved in any Census count. However, the Census Bureau offered ACORN the opportunity to "recruit Census workers" who would participate in the count. Moreover, as an "executive level" partner, ACORN has the ability to "organize and/or serve as a member on a Complete Count Committee," which, according to Census documents, helps "develop and implement locally based outreach and recruitment campaigns."

A few of its "members" were found to have falsified registration. And by "members", I mean "college students and other 'geniuses' who got paid a couple of bucks per card filled in and decided to fill in cards for Mickey Mouse to make extra beer money".

Acorn did the legally required thing and filed ALL cards submitted, just in case some guy happened to actually be named Charlie Brown.

So Bachmann is lying?

First it was President Obama trying to break all precedent and run the 2010 census from within the White House. While the administration finally backed down from that politicization of the census, it clearly hasn't learned its lesson. Now it is having ACORN officially "partner" with the Census to help count the number of Americans in the country. It's like Santa trusting a child to tell him how many times he or she has been good in the past year.

~Republican aide Alan David Berlin was arrested on charges that he wanted to engage in sex acts with a 15-year-old boy while dressed in a panda costume.

~Republican news producer Aaron Bruns was arrested on charges of possessing child pornography.

~Republican activist and former presidential campaign chairman Jeffrey Claude Bartleson was arrested on charges of sexually molesting a 5-year old boy.

~Republican activist and former chairman of the Christian County Republicans Royce Fessenden pleaded guilty to two counts of first-degree child molestation and one count of second-degree statutory sodomy.

Bored Horde: sepuku2: oldfarthenry: Now, we have minority governments that require elections every ten months but at least there's an attempt at tackling some legislation.

That every ten month thing would get tiresome.

It's more like every 2-3 years, and you guys have elections that are orgies of advertising every 2 years.

Yes and no. It really depends on how contested the election is - if it's pretty much out of reach (ex., Lautenberg vs. Zimmer - we all knew Lautenberg had it), then it's not really that heavily advertised. (I saw some Lautenberg ads last fall. SOME.)

On the other hand, something like Hagan vs. Dole (where it was neck-and-neck BEFORE Liddy called Kay godless) IS hell.

It's also the markets. You won't get sacked as much with election ads (on TV) in the NY or Philadelphia markets because it's so expensive to buy ad time here, and - for representatives - you're reaching ~10m people you don't need to. Out in the boondocks, where time is cheaper and less people live, you do get more ads.

The problem, of course, is that a lot of our elections are staggered. Add in gubernatorial elections (four months to go till Election Day, and Christie and Corzine are ALREADY going at it), and it seems like a perpetual election.

NONE of its members have been convicted of election fraud. They were convicted of registration fraud. That's different. All they did was submit fake registration forms to make it look like they were working when they weren't. And these forms were kicked back, because all registrations are screened, AND, because Acorn, as an organization, flagged them as potentially fraudulent, but by law they had to turn them in anyway.

- how I get to work

- how much time off from work I took

- details about my house, how many rooms, bathrooms, etc.

- details of my utility bills

- details about my mortgage

...and so on.

Because it's your civic duty to do so and it's far less onerous than say, jury duty, let alone getting drafted to murder women and children in southeast asia. No one in the government cares about your specific personal information, you're not that interesting. You're a data point.

If you think this is serious a violation of your right then you have no clue on the current reality of the abuses perpetrated by our government on its citizens. Let alone any sense of history.

Questions for the Census were submitted to Congress for consideration by March 2007 - when Republicans were in greater numbers in the House and Senate and controlled the White House.

Scary, scary is right.

I agree with Mr. Coffee Nerves - it's a bit unnerving to think that there is a segment of the Minnesota community that Michelle Bachman represents WITH THEIR CONSENT!

Can't say I disagree with being upset by the trend, but the worst of its been going on for years. Since 1937 at least. Really during the Nixon and Reagan years did it start getting particularly bad, the government waging a war against its own citizens. Effectively repealing the 4th, 5th, 6th, and 8th amendments. All Apologies 2009-07-02 12:19:50 PM
I think the GOP is seriously considering dropping Bachmann, her political style is better suited to the early 2000s.

You know, the Founding Fathers did have a fundamental distrust of government, but they also saw enough of a need for government that they established the basic foundations for government as we know it.

The FFs had an idea of what they did not want government to be, and that was one that was small enough to be dominated by one group, or a government that only acted in the interests of a few.

Because of the tendency for governments to be dominated by powerful minorities who then abuse the power, the FFs separated the government to provide checks and balances, as well as providing underlying rules which protected all people, and even provided certain rights to citizens.

Not only that, but the FFs included the need for a census, and specifically gave the government that power.

It's not entirely accurate just to say that the FFs had a distrust of government, they had a distrust of those who would try to dominate government for self interest.

Considering Michelle Bachmann, you have to ask whether she is someone the FFs would have taken seriously, or is Bachmann someone who the FFs would have used as an example of the kind of people they were worried about being apart of any government they established.

You gotta change the voting system. Winner-Take-All for every single elected office is no way to go through life, son.

If you go to a multiparty system you would also need to change the way budgets are done - stalemates are normal in a multiparty legislature, so you can't have government grinding to a halt every time the budget doesn't pass. You need to have it so that everything stays funded at its previous level, and budgets only modify the existing status quo once they are passed.

Sygerrik 2009-07-02 12:34:53 PM
Davey Croquette: They wouldn't, and they didn't. Next question?

So Bachmann is lying?

First it was President Obama trying to break all precedent and run the 2010 census from within the White House. While the administration finally backed down from that politicization of the census, it clearly hasn't learned its lesson. Now it is having ACORN officially "partner" with the Census to help count the number of Americans in the country. It's like Santa trusting a child to tell him how many times he or she has been good in the past year.
(Judicial Watch)

First of all: yes, yes she is. She does it a lot. It's kind of a thing with her.

Second of all: Yes, we all know ACORN is helping with the census. There are two things you are unaware of:
1) ACORN is not performing the Census. They are merely informing their employees that the Census is looking for people to ask questions. They're advertising, in other words. I guess if you believe that ACORN is a cutthroat gang of convicted felons you would object to this, because that's who would be advertised to, but if you believe that I have to ask what color the sky is in your world.

2) ACORN was never convicted of election fraud. Several employees were charged with voter registration fraud, which is different, since the false voters never actually influenced the outcome of the election (since "Mickey Mouse" never showed up to vote) and ACORN was the one who brought these people to the attention of law enforcement.

Some people don't even understand why the census is conducted, that's why they are so easily misled.

Acorn is a favorite target of Glenn Beck, he attacks them daily. It all leads back to the low information voter demographic that Fox News targets. If the viewers were even a smidge more informed, or a couple of IQ points smarter, they'd realize that there is no merit to this.

Fox News being a news station, on a cable channel, with lots of viewers creates a perception of validity that doesn't really exist.

With some people, you have to start with an explanation of what the Census data is used for. (new window)

I'm willing to guess that Davey has no idea why a census is conducted, other than for voter fraud apparently. Cause, you know, there aren't any other ways of finding out where the voters are.

xria: If you go to a multiparty system you would also need to change the way budgets are done - stalemates are normal in a multiparty legislature, so you can't have government grinding to a halt every time the budget doesn't pass. You need to have it so that everything stays funded at its previous level, and budgets only modify the existing status quo once they are passed.

True but irrelevant to my point. Once you have an electoral system which allows more than two parties to get into office in substantial blocs, then you have to come up with political solutions to the political problems that arise.

In order to get that kind of spread into office, however, you have to have some kind of proportional/party-not-individual/several-past-the-post election system. It's just not rational (in the economic sense) for large numbers of people to vote for someone not from one of the two major parties in most elections, if one of those two people is going to win. And that is exactly what has to happen under a first-past-the-post voting system.

/Differential equations. It's what's for dinner.

No, they're just a convenient bogeyman for them at the moment. Previously, Republicans supported their efforts. Like John McCain, who was their keynote speaker at a 2006 rally:

www.arktimes.com

When the GOP saw that their popularity was waning, that's when they started to attack ACORN, saying the Dems were trying to fix the vote. What they conveniently forget is that the only person convicted of voter fraud during the 2008 election was a Republican (new window).

Sygerrik: Davey Croquette: They wouldn't, and they didn't.

Oh, and don't forget that ACORN is one of 4,000 organizations helping out the Census Bureau in the same way.

Ok. Here's a Link (PDF) to the entire census and the reasons why they ask what they do. The toilet question is partly to determine how many elderly people live in poverty, and partly to determine which areas need general housing assitance.

Now, you may be OPPOSED to general housing assistance, or elder care, but that's not the issue. The issue is, if we are going to spend money on this stuff, let's find out where we spend it.

(and it's not HOW MANY toilets do you have, it's "do you have ANY toilets").

Davey Croquette [recently expired TotalFark] 2009-07-02 02:03:51 PM
Alright. well I gotta go. Half day and all that. Plus I got this new girlfriend. She's nice and I like her but ever since we kinda went exclusive she's become real needy, you know? Pick me up here, take me there, buy me this. You get the picture. I can feel the momentum picking up already- She's got wedding bells ringing in her head. Which I don't really need right now. Hell, I've got enough ex-wives to start a basketball team. The problem I have is probably the same problem a lot of you guys have: She's really good in bed. She's nasty. Internet-nasty not just Seventies-hairy nasty. Which I kinda wonder how she got that way but not really. I know she's been around. I'm just glad she's into it. My second wife had a few hangups especially south of the taintal region if you know what I'm saying. She really wants kids. Three of 'em. Which would take my total to 8+. That's a lot of kids to put through beauty college. I may have a talk with her about it tonight but maybe not because she's a little sketchy. I can see her just walking out which would suck because I'm super horny.

Update: New GF wants me to paint her garage this Sunday instead of playing golf. I'll probably do it. That's how I roll. I mean, I've got my whole life to play golf. How many chances do I get to paint a hot-ass, un-air-conditioned garage during the summer in Florida? Damn few. I'm curious, Ladies. Do you press us into your service KNOWING we're led around by our dix or are you just under the delusion we really want to do nice things for you? If i were a girl I'd conduct an experiment. I'd ask the guy I was farking to do a list of things. Then I'd ask a guy I'm not banging to do the same list. I hypothesize that the guy banging is a lot more willing to put up with the endless stream of honey-do's women always have for us.

Rev. Skarekroe: The Bush administration asking the same questions would have made it a patriotic duty.

I don't differentiate between the republicans and democrats in Washington. As far as their actions go, they might as well be factions of the same party, which of course they are. They're all bought-off, corrupt whores.

The sad thing is that we operate under the illusion of a representative government, when in fact the actions of the government represent the aims of a very few and powerful corporations and individuals (cough)DavidRockefeller(cough).

But then, there are still some people who think we went into Iraq to "protect our freedoms."

The Founding Fathers envisioned a many part system; and we ended up with an ipso facto one-party system that trades perceived "control" every so often.

The number of failed Bush policies Obama isn't bothering to change should have his supporters up in arms - but since he's so cute they just keep waiting and making excuses.

Obama doesn't control jack. He follows orders just like Bush and the rest did. The last president to actually try to act like he had some degree of power was Kennedy, and they put a few bullets into him just to prove a point.

Yeah, but she was trying to be p.c. and make the point reciprocally. It's not a big deal but when you have people who are scared shiatless of you, they will make a big deal out of it.

Bachmann wants to be fined and she wants to be the test case. The courts will have to determine the constitutionality of each item she is fined for. That is what scares the shiat out of the libs. There are even some questions that the libs know they will want rendered unconstitutional at some point but the questions are useful to them right now so they don't even want itemized rulings that go in their favor.

Bush, Palin, Cheney, Bachman, Bolton, Gonzalez, Brownie, Limbaugh, Hannity, Coulter, Beck, Savage...

Cheney yes, many times, and sometimes Bush when he did something right.

The rest? Never.

Bill_Wick's_Friend: Noam Chimpsky: Yeah, but she was trying to be p.c. and make the point reciprocally.

No.

She was wrong.

C'mon. Say it with me. "SHE. WAS. WRONG."

2 + 2 does not = 5. Doesn't matter what point you're leading up to and it doesn't matter that there was a finer more subtle (ha!) point to come. Wrong is wrong.

(having seen you in action before, I'm not at all suprised to watch you offer such a vehement defence of "wrong".)

You seem considerably exercised about a politician being wrong about a statement, as if they all don't do that often or for some of the politicians from the 57 states, on a daily basis.

Bachmann has steadily gotten crazier and crazier over the past year or so.

Its only a matter of time before she signs onto the Birther Conspiracy and starts demanding to see Obama's birth certificate.

Crazy! That's our Michelle, all right - tries to come off sweet, dreams of a permanent Republican majority, that sort of thing. From San Francisco to San Antonio, Rose Hill to Rochester, you don't find that strange brand of insanity very often. It reminds me of that scene in Dirty Dancing when Patrick Swayze is back in Baby's arms and she knows she has him. Republicans, she's got you, so if you have leaving on your mind just forget about it because our Michelle would be lovesick. Blues, don't think you're much better, but I'll shut up now before I fall. Two pieces of advice... oh forget it. Never no more will I bother to give advice where it's not wanted.

Noam Chimpsky, are you illiterate, or are you simply ignoring the dozens of posters who have repeatedly pointed out-- citing chapter and verse-- how any question that appears on the census is be definition constitutional, as the Constitution places no limits on what can be asked?

Phil Herup: He should be charged with felony tax evasion, but do you think that will happen with the Dems in control?

You do know that for that to stick, they'd need to prove beyond a reasonable doubt that the failure to report certain income was deliberately done, and not an accidental omission or error.

Generally, the only people who get convicted are people like Wesley Snipes who are tax protesters, people like Leona Helmsley who specifically instructed workers on how to evade taxes, or people who have actively set up schemes to hide money from the IRS. In all but a few percent of tax cases, there's no criminal charge, just penalties and interest.

Well Charles Rangel is THE CHAIRMAN of the House Ways and Means... they write tax law. He knew what he was doing. He is not stupid.

Are you a Rangel Apologist?

He is either incompetent or a tax cheat. Which will you accept?

/reasonable doubt? Please. He steals from you as well.

I'm a smart guy as well, and I've made tax errors before.

Nobody's alleging he didn't know he needed to pay taxes on that income, just that he forgot to include it. It was a relatively small amount of money ($4k per year on average) and until recently, the money was going directly to paying down the mortgage he had on the property.

Anyone who is going to try to cheat the IRS on purpose isn't going to nickel and dime it. We're talking him underpaying by about $1400 per year or so. $115/month in savings is certainly not worth doing that on purpose, considering just how harsh the penalties and interest are. The "reward" isn't worth the risk.

He was charged or convicted with what exactly?

He should be charged with felony tax evasion, but do you think that will happen with the Dems in control?

May you be a Rangel apologist?

I don't care about Rangel.

What evidence do you have? When the GOP was in control for 12 years, why didn't they do anything?

Scooter Libby became a convicted felon under a GOP White House and Congress.
