Subby, if they wanted Sonia Sotomayor on the Supreme Court- or, more accurately, if they aren't calling her a racist, socialist, communist, etc, and working feverishly to scream that as loudly as they can to passerby, they're not "Real Americans™".

Frankly, who cares what the public thinks about this kind of stuff? They don't really have any legal expertise. I'm much more interested in the types of things the people think the court should do, and then have the Representatives carry out the details.

And yet, whenever there is a chance to verify such polls (in an election, for example) they turn out to be remarkably accurate. It's almost as if the people conducting them actually know what they are doing...

Well, it's actually ultimately up to the whole senate. And this is a representative democracy, which is, in fact, a form of democracy.

Based on her case history I personally suspect that Sotomayor is going to be less liberal than most people on either side expect. She may well turn out to be sort of a liberal O'Connor, leaning on the moderate fence from the left side instead of the right.

The ironic thing is, she may well be to the right of Souter and thus will move the court to the right. However, the conservative base is so blinded by their Obama Derangement Syndrome that they will oppose anything Obama does.

It's not the math: it's the stupid questions.

So your complaint is that the poll doesn't do something that it doesn't claim to do?!?

The poll isn't about how Sotomayor thinks, it's about what Americans believe about her. Complaining that it doesn't get inside her head completely misses the point. It's supposed to get inside *our* collective head with respect to our attitudes about her nomination.

Mostly what the poll indicates is that the conservative FUD about her isn't working with the majority of Americans. I think that is accurate. I live in conservative Mississippi and it isn't even working all that well here.

Not to play devil's advocate here or anything, but there's a big difference in polling California or NYC, and the rest of the country. Also, a lot of people will simply state that they have no problem with a "Wise Latina woman" making statements that could possibly be construed as racist. Simply out of fear of being labeled a racist themselves. This is the unfortunate truth.

Has Sotomayor worked in the Justice Department? I thought she was a (county) prosecutor, private lawyer and then judge.
