Investigators say Lee blew a .228 on a breath alcohol test, which is more than three times the legal limit. He's been booked into jail.

Apparently the writer of this article was drunk, too, or just completely fails at basic math.

Depends on what the legal limit in that state is. Example: in Washington, it's .08 so three times would be .24.

His drunkjacking was well intentioned but could have been dangerous to himself and escalated the danger to others. (Drunk tries to avoid having car taken over and steps on the gas to throw good citizen out of car.)

Why not just shoot out his tires?

AFAIK, .08 is the limit in all states.

Seriously, glad he was stopped before he killed or hurt somebody. Pretty sure I would not have reached into the drunk's car.

You speak some truth there. However, you can be so drunk, well above 0.08, maybe 0.25, and can't control the car or make bad judgments.

But yes, tired and even falling asleep at the wheel is probably the most common cause. Alcohol doesn't affect reactions as much as it affects judgment, ie, entering the corner too fast is the cause, not braking too late . . . "I can do that" shiat.

But we also need to get the prescription drug and anti-histamine crowd off the streets, being tired has the same affects, some states already recognize this.

While police don't recommend people try to stop drunk drivers themselves, they're calling Kirkham's actions "brave." Kirkham says he was just thinking about the daughter he dropped at driver's education that morning.

"You think about your daughter on the road and these things become real personal real fast," he said. He's been booked into the Utah County Jail.

Did Kirkham get arrested too, or does the writer just suck at pronouns?

geetus 2009-06-28 08:43:41 AM
I did the same thing to a guy who stole my car when I was in college, except I didn't call the cops. I threw his ass out on the street, punched him in the face, smashed his walkman, and helped myself to the rest of the beer that was in the back seat. Too bad he had it long enough to put a nice big dent in it (my car, not the beer... well, that too).

Some friends helped me track him down. It wasn't a very big town. Took us all of about an hour to find him. I'd been at a friends house whose mom was farking this low life. He stole the keys out of my pocket while I was asleep & just took off.

More wasted money on a war like the 'War on Drugs' that is un-winnable.
Decriminalize it, Legalize it and the problem will go away.

Better yet, develop cars that can drive themselves (auto pilot), detect others around them, obey traffic laws. That would solve all of the issues with drunk driving, accidents, etc..

True, as far as it goes. But the man who took his key did not observe "drunk," not until the car door was open anyway. He observed Wanton Disregard for the Saftey of Others. WDSO is the crime here, not DUI.

gorfie 2009-06-28 09:08:37 AM
It's great that a drunk was taken off the streets but the "hero" could have easily been a criminal had the driver not been drunk or had the intervention resulted in additional casualties. It would have been better to simply call the police and keep a distant eye on the invidual so the police know where he/she is.

So the cops thought he was brave, then they arrested him.

FTFA:

Kirkham called Utah Highway Patrol and was told no troopers were in the area, so he continued to follow him.

That's some fine police work, Lou. "Sorry, there's no one available right now. You'll just have to follow him around yourself until we can pry one of our guys off the 47 speed traps we have set up in Pleasant Grove. That OK?"

Was kidding, I got a DWI 20 years ago, was 18, .224 and I really should not have been on the road. Drunk driving is bad.

That being said, and this is horrible, in my younger years I have driven hundreds of times drunk, many times not even remembering the drive the night before, several times having to search for my car because I didn't know where I parked. How can somone be blacked out drunk and drive?

Thank God I stopped doing that, I am ashamed of that period.

It's 0.05 in Colorado. Sure, 0.05 is only a "Driving While Ability Impaired", but you still have to go through a lot of BS. A friend of mine was charged with one (charged, mind you - not convicted) and he had to go to weekly classes just to keep his license.

Many of the same people will tell you that so-called "terrorism" (which takes maybe one American life for every thousand drunk drivers take) is our number one priority.

I had something like this happen when driving through Arizona once. I was on I-10 north of Tucson, and a guy was weaving back and forth, cutting halfway into the other lane and forcing people to slam on their brakes. Then he started drafting a truck. I called 911 several times, and they took the info - but it was 40 miles until we passed the troopers - turned out there was a patrol station there and they just camped out next to it waiting for him. They finally pulled him over. He was gonna hurt someone.

Yep, in Colorado the Department of Revenue will take your license immediately... then the court can take it again if you're convicted.

I got passed by a drunk driver a couple years ago, he was all over the road, and both ditches at about 70 mph. I followed him to the closest liquor store. When he got out of his van to head inside I nabbed the keys from the ignition, walked past his staggering carcass into the store and told them to call the police. The store owner refused to sell him more beer so he tried to leave but couldn't find his keys. When the police showed up I handed them the keys and told them what I saw. Turns out he had about 5 DUI convictions already and was the mayor of a neighboring town.
Nope, I didn't get sued.

I was in a similar situation once, except I wasn't a self righteous dick about it. At 3 or 4 am one night I pulled up next to a guy who was passed out behind the wheel. I knocked on his window and woke him up and told him to get his ass home before he gets arrested. I felt no need to be a tough guy cop wannabe.

Additionally, in Colorado, if you refuse a BA at the scene, you automatically lose your license for 6 months. And if you opt for a blood test at the station instead, know that it's likely that your level will rise as your body continues matabolizing the alcohol.
I happen to work for a lob that tests offenders, so getting a kick...

FTFA: Kirkham called Utah Highway Patrol and was told no troopers were in the area, so he continued to follow him.

Meanwhile, Bountiful police launched a DUI blitz Saturday night that will run until about 3 a.m. Sunday. More than a dozen officers were stopping cars to check for signs of impairment.

Officers conducted a similar checkpoint about six months ago that netted 11 DUIs as well as numerous arrests for drug possession and outstanding warrants.

There's your real heros subby.

Coming back from Illinois a few years ago, we got passed on I-80 by two college kids in a convertible. The driver was weaving in and out of lanes, checking his hair in both the rear view mirror and driver's side view mirror, speedig up and slowing down abruptly.

They got off at an exit and we followed. They pulled into a gas station and the driver not only could harldly stand, but had a lot of trouble getting the pump nozzle in his tank. My son copied down the plate number and we went to a restaurant across the interstate where four Iowa Highway Patrol cars were parked. I went in and found their table and told them what we observed. They didn't want to do anything at first, assuming the guys were on the road and long gone until I told them they were gassing up a block away. One of the troopers hustled out of the restaurant to his car. As soon as he got to his car, my daughter yelled out, "There they go!" and pointed to the car weaving out onto I-80. The trooper took off, burning rubber. five miles down the road, we found he had caught them and had the driver in custody. The passenger looked like he was looking for a way to get rid of contraband while the troopers back was turned.

Very amusing and satisfying.

Yeah, except for the wipers and hitting the reflector posts I see driving like that every day during rush hour. Maybe someone should be jumping into their cars and grabbing keys.

Do you know how long it takes to reach in and turn off a vehicle? Do you know the reaction time of a man with that much alcohol?

This was clearly the safer option.
