That's part of the problem. In order to service clients, lawmakers have to enact laws that require a LOT of parsing. The bulk of legislation that the Congress has been engaged in for the last 20 some odd years, has been focused on strictly defining things--and not just marriage. The stricter the definition, and the more hair fine those definitions, the easier it is to slip past legislation.

"We were only dumping X amount of dioxin--the law says we can't dump Y amount!"

"We can have four rat hairs per batch, and you only found three..."

Damage caps and the like are to protect folks by making things very clear cut. Not the folks who bring the suits, but it's entertaining that the "litigious culture" has been fostered not by folks looking for damages, but by companies who want to slip any hint of responsibility. A great deal of the rise of the lawyer in the country has been on the corporate law side--not just in the creation of legal fictions as commodities, but to help write legislation to regulate their own industries.

I suppose, that is part of the problem, is that lawmakers are being asked to write legislation, as opposed to having it handed to them for their support.

Legislating is hard, when you have to do it yourself...

Sometimes I think it would be nice if all laws not passed by some really large majority (think amend-the-Constitution large)were automaticly given am expiry date. Keep Congress busy renewing old laws and keep them largely out of trouble....

I have never seen a group of people so clueless as what to do next than the GOP.

I almost feel sorry for them, you know? Bitter politics and resentment aside, I kinda do. I mean, fark them and their views and attitudes, but it must be a frightening prospect to face your own obsolescence. I have no doubt that they'll figure out some smarmy way to rebound by slinging the most mud, outright lying, et al, but even if they get one more go at the big chairs, I think they're honestly a bit of a dying party, at this point.

Maybe they'll rebound completely, but they'll never again be what they are. And they know that. And they're honestly terrified--TERRIFIED--and covering it poorly. So yeah, I almost feel sorry for them.

Kind of like I feel sorry for a racist confronted with how racism is the dumbest thing on the planet. Because it's comforting to them, especially since it might be the one thing in their lives they have some control over. Letting go of these views is really hard.

Poor little old rich white guys.

The problem with that is that there's no logical reason (for Congress at least) to re-up good laws which tie their hands.

Up until Bush Jr took office, there was a law that said that every dollar of spending in the budget had to be paid for with a dollar cut or a tax increase.

The law expired and Congress went nuts, passing (among other things) the multi-billion dollar prescription drug plan which had no funding in the budget.

Yes, Obama does not make laws. The only thing that goes through congress that Obama originally creates is the budget (and even then, it's usually ripped to shreds by the time it passes).

Which is why I'm pissed at all these people attacking Obama for not overturning DADT or other things.

Well in theory he could use an Executive Order to change DADT. But to be blunt, it's just not worth the political capital expenditure and the fallout. Sorry, friends, too little upside for too much risk. My family owns 3 Saturns, but no way in hell we're gonna invest in GM right now.

UCMJ is written and controlled by Congress. Obama can stop it from being enacted through his control over stop-loss, but the actual policy on the books has to be repealed at the Congressional level.

The Republicans appear to be chewing on one foot while shooting themselves in the other. As for the Sunday morning "talk shows" the only one worth watching is Bill Moyers. The rest are an embarrassment to the schools of journalism the network employees attended. BTW does anyone know if they actually graduated in journalism?

UCMJ doesn't actually specify the DADT policy. The Congress has delegated the responsibility for developing and implementing specific rules to enforce DADT to the Secretary of Defense under 10 U.S.C. § 654.
