Really all you need to do is get a saw and just cut a tiny notch all the way around the bark right at the base of the tree. But I think this news story might be enough; I have a feeling someone will "help her out" with this now.

At first, I was going to post wondering who the hell would object to a tree, but after RTFA.... Yeah, I can see her point.

She specifically got an answer before the program that they wouldn't plant another tree. She PAID to get the place paved over. NYC or Brooklyn has a retarded ordinance that the homeowner of a CITY PLANTED TREE is responsible if someone cracks their neck because of slipping on a fallen leaf, and she can't do it.

I can completely see her position, especially after the forestry guy threatens her awesome neighbor, a one-in-a million person herself for actually sticking her neck for someone else in that city, with jail just for a legal protest.... Wow. What a world.

Seems like this article went really far to make this into a huge deal. I mean, it's a tree in a tree pit. I'm real sorry she has some sort of sentimental attachment to there not being a tree there but is it really her sidewalk?

And honestly, let's not pretend like all of us in this city have to go around raking up the abundance of leaves in the fall.

Sidewalk trees are stupid anyways.

I don't think the seasonal beauty of some multicolored leaves and blossoms is enough to compensate for the raping that the root system will lay on the sidewalk and street. There are sidewalks you could ski down in L.A. because of these damn streetside trees.

I love trees. I think they are beautiful, amazing plants. I love hiking through forests of them.

However, I also love flowers. I would be perfectly happy with patches of flowering plants along sidewalks. Flowers that look pretty but don't block street signs so I can see where I need to turn. Flowers that have small roots that won't hurt pavement and sidewalks. And flowers smell nice.

I have a ginko in my backyard that produces the aforementioned smelly fruit. Fortunately the fruit starts rotting late in the fall when it's already cold and I'm not using the backyard as much. I would NOT want to have this tree on a sidewalk. Some of the fruit actually rots on the tree and falls to the ground and splits apart. It would be hell for pedestrians - like walking on dog poop.

That being said, they are slow growing trees and she may be long gone before it starts to produce significant fruit (assuming it's the female tree).

It says that it has the right to plant the tree...but doesn't have to maintain the tree, and doesn't have to take responsibility for liabilities caused by the tree.

Only the government could think up a perfect ass-cover like that and have it work.

One of my friends lives on a street with these kinds of trees. Yes, they smell AWFUL. My first time walking to her door from my car, I kept looking down to make sure I wouldn't step in the pool of vomit I assumed I was smelling.

Frankly, I'd like to see a lawsuit brought against the city for destroying something a citizen invested in (after checking with the city) and are now forcing liability on her.

How about, oh, I don't know, one of her neighbors being a good samaritan and doing the leaf cleanup for her? She clearly lives in an area where she's got lots of neighbors. Are people really that insular and self-absorbed that no one there would be willing to do this?
