The Harriet Miers tactic was brilliant. Nominate someone wholly unqualified for the position so that the next person you nominate looks incredible by comparison. Except I don't think that was the tactic. Alito probably would have been confirmed even if he hadn't been preceded by Miers.

In general, though, it's a good tactic.

Eh, maybe, but as i understand it Miers pulled a Cheney.

Most people don't know, W hired Dick Cheney to field him a vice president.

Cheney put dozens of people through an unprecedented vetting procedure that included, among other things, giving Dick Cheney access to their complete medical records in perpetuity.

And then, after all that, Dick went back to W and said, "I've searched high and low, and it turns out that the best man for you is . . . . ME!"

And W totally fell for it.

Miers was tasked with finding a supreme court nominee and selected herself.

I don't think Bush could have figured out that tactic. I think he just picked the nearest law-talking person he knew.

That's not quite the case. You should check out the book "The Nine" about the Supreme Court, and the author talks about that time a bit. It's more like Bush just picked the only lawyer he had a personal relationship with at a high level, even though she had no real conservative credentials, judicial experience or support from the Republican Party.

We just had a discussion in my living room about this specific issue, and even Malkin was against her nomination to begin with. I'd still like to go back and see what Limbaugh et. all thought about her, but I'd bet that there was widespread condemnation.

As a mini threadjack, I've been hearing for years about how if a Dem won in 2008, they'd nominate either or both of the Clintons to fill a vacancy on the Supreme Court...ignoring for the fact that neither has judicial experience and Bill was farking disbarred. I guess after the Miers affair, people think that the President is pretty much goin to draw names from a hat to fill a vacancy.

Actually, MY legal sources just came up with a list of people McCain would have nominated:

First off, is a woman who graduated from Cornell and then from the University of Law School, and passes all the conservative litmus tests:

Fun fact: The president can nominate whoever he damn well pleases for a seat on the Supreme Court. The only requirement to be a sitting justice is that you are confirmed by Congress. So yes, even everyone's favorite disbarred president can be a justice.
