Really though, someone explain this logic to me: "Well, one of my fundamental rights as an American is the right to refuse to take the stand, slip up, and sign my own prison term. "I'm single" only works for women. "I'm seeing someone and therefore most likely emotionally unavailable" is, for some reason I will never understand, the most successful pick-up line for guys.

Just because it's common doesn't mean it's ethical or correct. You are right though, it is not at all uncommon, but I suspect the words are typically more carefully chosen.

We have been swingers for a long time and the people who shouldn't be in the lifestyle are pretty easy to spot. They're the couple who come to a party and one of them goes completely wild while the other is either standing by the door for an hour ready to leave, off somewhere crying, or making a complete arse of themselves. They shouldn't be in the lifestyle. My swingers group weeds them out pretty quickly.

What, telling your clients that what they want to do is wrong, could lose their case, and that since you the attorney are the one who has the legal knowledge and courtroom smarts to hopefully win their case, they the clients should shut their mouths and do what the attorney tells them to do?

I'm not sure you grasp the idea of what having an attorney represent you in court means. It means shutting up and doing what your attorney tells you to. Mr. Elash just says so out loud and up front. He's tactless, but tact doesn't win cases.

But if you want to pay someone $500 an hour so you can not do what they think is best, and wind up with a first-degree murder conviction, that's your option, I guess.

Ummm, it is perfectly legal and ethical for a private lawyer to tell you how they are going to present your case. If you don't like it, you fire them and get another one. There is no law saying they have to represent you, nor is there a law saying they have to do what you tell them.

This is why you will sometimes see someone get a lawyer, then a new one before they go to trial. They can fire their lawyer, or the lawyer can quit.

The only lawyers who get saddled with having to do whatever their client wants is public defenders.

Now that said, a lawyer can't play change up with their client. They can agree to defend their client on certain grounds and then refuse to do so in trial. However they are perfectly free to say "No, that defense is stupid and won't work. We either do it my way or I'm leaving and you get someone else."

I remember a murder trial that went like this. Guy killed his parents, rather brutally. So this was big local news and a fairly big name local lawyer represented him. Next day, it was a different lawyer listed in the papers, a mistake? Couple days later, it was a public defender, so NOT a mistake, guy had changed lawyers twice. The reason? His defense was that he didn't do it, his alter ego "Hondo" did. Ya let me tell you how well THAT worked out for him. Lawyer #1 and #2 weren't going to argue that shiat and so quit.
