In spite of that, Revenue Canada really have been bastards to this guy. Heard him on the radio the other day. Revenue Canada's own auditors told the guy to sue them, because it was the only way he was going to get them to leave him alone.

Irvin says the CRA lost his records. He could be lying, of course, but here's the money quote from that article:

In 2005, he took his case to the Tax Court of Canada, where the CRA gave up in a so-called consent to judgment, essentially admitting its mistake. That reduced Leroux's personal tax bill to zero and his GST bill to $20,000. Documents show that by 2006, Leroux was actually owed a $24,000 tax refund.

Is that your legal opinion? Because it sure sounds like malarkey. Making copies of your records may be commonsense, but failing to do so probably isn't grounds for having your property confiscated by Revenue Canada.

I actually think there's probably a little more to this story than Irvin is saying. But who knows? The CRA ain't talking.

Haven't RTFA, I'm taking a course on Records Management right now. The rule is if anyone in authority wants to see them, and they have a legal right, you never, never, never get rid of anything until you are 100% sure you can get rid of it safely. In the US there are actually legal holds placed. I don't know about Canada. But getting rid of any records while a tax group is looking at them? Seems idiotic to me.

But you see, he didn't get rid of his records. He gave them to the Canada Revenue Agency, who accidentally shredded them. (At least, that's his story.)

Anyway, this case isn't about his records. From time to time records get lost or burnt in fires or stolen or ruined in floods or destroyed by a helpful tax auditor. There are procedures for this; and it appears that Irvin Leroux followed the procedures, because the court reviewed his reproduced records and found that CRA owed Leroux money and not the other way around.

Moreover, as reported by the Ottawa Citizen, "In another email message to constituents Irvin Leroux and his wife Jill Moore, Harris said he had spoken to then-Revenue Minister Carol Skelton about their case. He said Skelton had told him she would use the case an example for a taxpayer's bill of rights and to illustrate how the CRA abuses Canadians."

Yeah I know: sounds like Dick "Hizbollah" Harris is exaggerating and running his mouth again. But don't be fooled into thinking this asshatted MP has anything do with what looks like a clear cut story: some CRA asshole at a local branch made an error on Irvin Leroux's audit, and instead of checking his work or admitting the mistake he sicked every federal resource at his disposal on the poor guy.

I simply implied that if the auditor didn't give the guy a chance to make copies of the records before taking them in for review (and then accidentally shredding them) then the guy has some cause for complaint.
If he was given notice and therefore time to make copies, but didn't, then the guy's a dummy. I'd feel for the guy, sorta, but CRA's mistake wouldn't outshine his mistake.
