Legal, how about simply wrong. Sometimes even if you proofread stuff slips by.

The guy in the article is a putz. The deed restrictions say use a leash, and since this is in my county I know that a county ordinance requires a leash, the guy just wants to be a dick and not follow the rules. He was fined $1000 and he could have paid that but he decided to violate the rules over and over and bring a lawsuit against the association.

I hate homeowners associations because they foster tiny dictators and I would never live in such a community. However you can't buy a house in one unless you sign something saying you have read the rules and agree to them. His wife did, and he is just farking her over by continuing to be a dick. A grand in legal fees, or the principle of walking your dog without a leash. I an going to have to call him an asshat.

I am never picking up dog crap. Sorry, not something I will ever do. It is absurd. However I don't let my pets crap where I would have to pick it up.

I don't care if other people let their dog crap on my lawn and leave it there. My neighbors know that and I've told them if it bothers them they can blast it under a shrub with the hose if they want.

For decades nobody picked dog crap up, what is the fascination with picking it up now. Geez, if it is on the sidewalk, kick it into the gutter. You would be better walking the dog where it can crap in peace and not on a sidewalk or a playground.

I read the headline and somehow knew it had something to do with a homeowners association.

Sure enough, I look and see... homeowners association.

I'm never moving into a house where one is, and I'll find a neighborhood where there isn't one. They're still out there, and I'll do it even if I have to buy the land and build the house myself.

I used to walk my dog without no leash. I had a deal with that dog - you stay out of trouble, and you get to walk free. First ticket you get me, you're on a leash.

I never got the ticket, even though it was a leash-law town.

Douchey DogWalker then fears that he is in imminent danger for his life, i.e. going to jail for an extended period of time.
Dude grabs his sawed-off (placed neatly beside the door for just such an occasion).
Dogwalker McGee removes the head of the HoA Director with the shotgun.

Was he in imminent danger? Probably not.
Was he in his mind? Who knows?

The guy is a farking real estate broker. This means that he ought to know better than the rest of us the many ways in which a HOA can stick it to people. He knowingly and willingly continued violating the rule. He's a tool and deserves foreclosure. Every choice has consequences, and he made this choice, fully informed, multiple times.

Out here, the leash law is also a city/state law IIRC, so the city would fine you for it as well.

/bad owners with non obedient dogs spoiled it for everyone else

Normally, I'm very much anti-HOA but in this case I'll make an exception and stand by the HOA (even though it makes me feel dirty).

The man in question, Wirth, flagrantly violated the rules (which honestly, is not that outrageous, leash laws are by and large a good thing). He does this repeatedly and the HOA fines him. Now, personally, $1000 seems a little steep but then again, this guy owns a house valued at $380,000, so I guess if you don't make it that high, then it won't really sting and thus won't serve as a deterent. Wirth refuses to pay, the HOA, per thier rules and the agreement that Wirth has with them, slap a lien on the house. He continues to not pay, and the HOA forecloses (I will say, laws regarding HOA's ought to be rewritten to where HOA's can't foreclose on a property until the property owner owes the HOA at least half the current market value of the house in fines/liens to the HOA. For small fry stuff like the fine in this article, they ought to be required by law to go to small claims court first.) The man fights the foreclosure, and rather than shelling out the $1000 and making it all go away, he balloons the total up to $40,000. Court order him to pay, he refuses, and actually threatens peoples lives using probably the most tortured twisting of logic to define the lawsuit against him as some kind of 'imminent threat' to his life.

The guy is a grade-A dick of the utmost order. And in this one instance, I hope the HOA buries him.

Going to jail is not imminent fear for your life. You must believe that someone is trying to kill you right then.

Sawed off shotguns are NFA weapons, if he has a license for an NFA weapon a comment that silly could and most probably would result in its revocation.

As I said before, the guy needs a mental exam. I doubt the HOA will be dropping by, it will probably be the Sheriff serving the papers.

My last HOA was great. Got our yards mowed and fertilized, took care of the streets and sewage system, took care of our trash pickup, and told the crazy lady she couldn't paint her house bright purple. All for fifty bucks a month. Hell, I would have paid that just for the lawn care.

And other than that they left us completely alone, except for having a couple bbq's with free beer each year.

The homeowner is responsible for her invitees.

If you go into a neighborhood and allow your dog to run loose on private property you can be charged with a criminal offense. So, no they could not fine you but you could get arrested. If you stay on the street you are probably OK, but why would you bother.

Growing up, I lived in a covenanted community. Even though my parents were the ones who signed the contract, if I broke the rules they got fined. I would imagine that his scenario is one of the following:

-She may have signed it, but he was added to the deed after the fact;
-He lives at the house, so he's bound by the rules;
-She's the one getting fined.
