Yes..in the Pacific NW. I've had cops and paramedics in my apartment several times, with a few plants in plain view. They never took the plants nor my personal stash. All I ever got from them was kindness and well wishes.

Damn this shiat angers me. First of all, the neighbor who ratted him out is an uptight prick. Secondly, who the hell cares!!! Most importantly, I have a 2 foot tall male plant on my fenced in patio that I'm growing for the hell of it. If some cock peeks through the slats and calls the cops, can I be arrested? It has no buds, so it probably has no THC. (Like I said, i'm just growing it for fun, i like plants, I don't know how to grow buds) If so, then whatever, bring it on. The arresting officer probably went home that night and slammed a six pack of Budweiser. Land of the free!!! Hooray!!!

Looked into this defense myself... apparently, back in the 1840-50's, the Supreme Court ruled that you cannot argue the validity of the law as a part of your defense. That was my understanding at least. I am sure someone on here with more legal understanding than I would be willing to comment in more depth, but I do know that, outside of TV and movies, you cannot debate the merits of the law for which you are accused.

I would guess it is due to one being a legislative action and the other a judicial action; and how those two things are supposed to be separate and checked against one another. I did not read anything other than the summary, to be honest, as it depressed me so.

/Had such a good speech all worked up in my head and everything.

Not until we overturn all the civil forfeiture laws that allow those cops confiscate his car, his house, and everything inside as "evidence" and auction it all off.

Not until we stop letting the prison-for-profit industry lobby lawmakers for more and more peaceful prisoners it costs them pennies to incarcerate (as opposed to those expensive hardened criminals).
