(1) You should pick your lawyer for skill, and even Mr. Lileks admits the guy is good.

(2) Lindh went abroad to fight in a foreign civil war. While that's not necessarily the smartest thing to do, I do agree with his lawyer that he wasn't setting out to be any sort of terrorist against the US.

Remember, the Taliban weren't branded Enemy No.1 of the US until after 9/11 - when women's groups were complaining of the regime around 1996 they were often laughed at as bleeding heart feminist liberals even.

Killing Afghans? Yeah. There was a war on. But it's not like (a) any big names in the US was all that concerned about them either (see above) and (b) the US kills in wars all the time (as do all other countries) so it's not as if war is some special terrible beyond the pale thing, on a grand scale, to the public. The US has had its share of proxy wars too.

Kid was crazy fervent new convert to religion in the WORST starry-eyed foamy way, went and fought in what was a local conflict that no one really gave a shiat about in the US, then oops! war with the US starts and he's fighting on the wrong side in that civil war. So he was fighting against a US ally, that became a US ally only AFTER he joined in the fight.

Clean cut Boy Scout? Hardly. But trrrst out to get the US? No.

Heck, I remember at the time there were suggestions to just strip his citizenship and let the Afghans have him, particularly when the Northern Alliance (with US help, of course) were winning. Honestly he'll probably live longer back in prison in the US, though...

In the United States every person accused of a crime is entitled to a proper defense. Since that includes guilty people, lawyers often end up defending guilty people. This is called due process and does not mean the lawyer likes or supports criminals.
