He was 18 and an adult. The law presumes one of 18 years of age is of the age of legal capacity. You can vote, you can enlist in the military and go off to a foreign land and kill people, and I think you should be able to buy alcohol and lottery tickets. As far as the law is concerned, he should have been aware of the law and the consequences of his actions. It was stupid, it was immature, and unfortunately for him, it was felonious. Welcome to adulthood, pal.

/As an aside, this is not just a failure of law enforcement and the legal system. This is a failure of parents as well to instill even a modicum of common sense about the severity and consequences of sexual pictures. But then again, our society reinforces it up until the point of no return, so it's a crapshoot on their part as well.

Nudity amongst teenagers is hardly a new phenomena as you said. However, the ability to transfer it en masse with ease is.

/Also, far more people have the ability to take said pictures. Cameras weren't necessarily available to everyone back in the day.

This is so silly, ruining lives because someone forwarded a picture of their naked sex partner. Teens have been doing this for ages, it's just easier to share now thanks to technology. Without evidence of something more, we all know there wasn't an intent to distribute child porn -- it was just a guy showing his buddies nude photos of his girlfriend (though the guy who sent the nudes to his grandparents is a little strange).

All it does is water down all the sex offender status reports (or whatever they're called). I do not care about the sex offender across the street who emailed nude photos of his girlfriend when they were both teens, even if one was 18 at the time.I do care if the friendly old man around the block can be a little too friendly with children -- that's the guy I want to be warned about.

My original thought was if she was legal to have sex with then why is it illegal to have a naked photograph of her. Then, I looked up Florida's age of consent. Sorry dude, your screwed. It was a douchenozzle move emailing those pics anyway. Just post them anonymously on a website like everyone else does.

Yeah, he was a dumbass for his actions. But, he got whacked by a really big stick meant for dangerous, repeat felons. The sex offender laws are too extreme and messing up too many lives nationwide.

There is definitely something to this. Anyone who is dabbling close the edge with erotic content had better be aware of the laws. We don't cut senile old people slack when they crash into farmer's markets. I don't see why this should be necessarily too different. Now....if both kids are underage, I think that's a mitigating issue. Why wasn't the ex-girlfriend charged with creating child porn in this case? In any case, it seems very odd that a person could be charged with creating child porn by voluntarily taking a picture of themselves. Especially if s/he is of driving age, and is legally capable of managing a ton and a half piece of fiberglass and steel in public.

I see no problem with this.

First off, he's not a 15 year old kid who got a nekkid picture of a girl and forwarded it to his friends and got caught.

Secondly, he's an 18 year old MAN, who has, I assume at least a basic high school education. He got all pissed at his ex girlfriend, who happened to be underage, and in a vengeful act forwarded a bunch of nekkid photos of her to her parents, etc, etc, etc.

This isn't some innocent mistake by some kid who doesn't know better. This was a planned act by a person hell bent on destroying a girls image/reputation just because she pissed him off.

Charging him, convicting him and making him register is appropriate. It would also be appropriate to remove his name from the list after the successful completion of a probation/counseling program.

Either way, he's a farking idiot.

I remember a story on dateline or something of a guy in texas who was in a teenage relationship, and the girls parents deccided to punish her for disobeying by calling the police on her boyfriend. the cops arrested him, charged him with statutory rape, and be a registered sex offender for the rest of his life.

the parents tried to call off the cops, out of guilt, but it was a no go. Once it got to the cops, it was out of thier hands.

SOmething like 10 years later, the no longer teenage couple was married to eachother, had three kids together, but the guy STILL has to re register every year as a sex offender.

I dont believe the sex offender registry works.

I think sex crimes- REAL sex crimes, should be dealt with much more harshly, but things like this and the article are just over kill. and cops- they will tell you that its the law and they are jsut doing thier jobs. Yeah, so were the nazis.
