It was a great story until the last two paragraphs.

In America court rules often say you can't get a default judgment against the government.

I don't know who to root for. On the one hand I think parking tickets are BS, but on the other this guy got four tickets and claimed emotional distress. Sounds like a dick to me.

FTA: "Last month the council - which claims it never received the summonses - took the case to Bow County Court, which ruled in its favour and ordered Mr Noon to give the money back.

The problem there is that Mr Noon cannot repay the money as he has already spent it"

Har, he sounds like a right chancer. It wouldn't surprise me if he knew they guy at the council who was supposed to respond to the summons and fed him 5 grand not to show.

Sir Cumference the Flatulent [TotalFark] 2009-02-08 12:11:53 PM
If that happened in the US, the guy would end up dead at the side of the road late at night with drugs and a weapon strategically planted on the body. The police don't like to lose.

I guess not parking where you're not supposed to and not being a whiny asshole weren't options for this crybaby?

"After Newham Council failed to attend the hearing the judge awarded £20,000 - £5,000 for each ticket
A further hearing at the High Court took place, giving Newham a chance to challenge the award - but once again the council failed to turn up."

Judges love people that don't show up for hearings, it makes things really easy for them.

So, a guy gets £200 in parking tickets, is distressed by bailiffs, then wins £20,000 because of the ever so stressful encounter with the bailiffs, then sends bailiffs to collect it.

So, now I suppose the cops should sue this sniveling prick for £2,000,000 for being stressed out by the bailiffs.

And how the hell is this in any way heroic?

FTFA: Mr Noon's farcical battle against Newham Council in east London started in October 2007 when he was apparently captured by a council CCTV camera committing the parking offences.

LA Farkers?

I got a series of parking tickets for not having my front license plate attached (it was on my dash, since my car didn't have a mount for a front plate) and when I wrote to contest the citations, I got a letter saying that if I took a dated photo of the front of my car with the plate on it, found the citing officer and had him sign the photo and then mailed all that in, they'd refund $10.

/then the parking violations bureau sent me a 'how'd we do?' survey to make sure I was a satisfied customer

And judges have the right to not give a fark.

I contested a ticket in court where a cop pulled me and two other people over at the same time; none of us were near eachother or going the same speed, and he only used radar on one of us. The judge even said that it was improper procedure and shouldn't have been done, but because I'd gotten a speeding ticket 3 years ago he declided to even reduce the ticket.

Same thing I came to post. If he was stressed out by the bailiffs, and then sent bailiffs of his own to the council, they should counter-sue him for intentional infliction of emotional distress.

Bet they wouldn't get the hero tag for that, though.

Americans are quite happy to see their constitution dumped on providing their party is the one doing the dumping. Read court opinions here and you realize the judges interpret the constitution however they damn well please.

No, the citation(s) said that I could contest by mail. If there was a section on appearing before a judge, I dismissed it because that means paying the court fee, and I thought that my case was reasonable enough that writing a letter would do the trick.

I forgot that these things are all about fundraising!

Of course, that's precisely why they don't allow jury trials for parking tickets.

Six years ago I was pulled over in the middle of a traffic jam (in which I'd been sitting for TWO HOURS) and given a ticket for doing 76 in a 55 construction zone. (the corridor I was in was a construction zone, but I hadn't gone above 4mph in over 2 hours) It was for $375. I went to fight it in court and thankfully the cop didn't show up-- but the judge still admonished me for speeding. I stood up and said "No, I'm here today because I wasn't speeding and I am not guilty of this", and though he couldn't make me pay the fine (since the cop didn't show in court) he still gave me a lecture.

/innocent until proven guilty my ass

Sure, the guy was a whiney biatch about the parking tickets, but the average Brit won when this happened. No more farkin cops acting as Gestapo.

Cops are the agents of the government...but isn't the government supposed to serve its people? Parking tickets are a disservice to society and create negative externalities. Perhaps tickets for parking in fire lanes is one thing. Double parking is another. As for expired meters, the cops should just STFU and GBTW. Time expired? Big whoop. Go chase down the real criminals- pedos and murderers- you scum.

Can'tLetYouDoThatStarFox 2009-02-08 03:10:02 PM
If anyone ever gets a ticket for parking on a public road in a "Resident Only Parking" zone, send in a letter saying that such laws violate the Privileges and Immunities Clause of the Constitution. They'll dismiss your ticket to deny you standing so that the law can't be challenged and they can keep collecting revenue from the 99% of people who just send in the money due to the hassle of contesting it.

It's an ingenious scheme they have going, really.

1. Pass unconstitutional fining scheme
2. Dismiss all challenged fines to deny standing
3. Profit

I think people should be able to park wherever they want on public roads for as long as they want as long as their registration is valid and they are properly parked near the curb. We paid for the roads, we should be able to use them without being constantly fined and terrorized.
