In America the system is designed so the criminal sentence is a small part of the punishment for DUI. Most of the penalty is for being accused of DUI. It may be the same over there. So good luck with that suit, the system deserves to lose. But like the judge I'm a bit skeptical that the real driver ran off leaving this guy standing outside his car not knowing what happened. To his credit, though, if he made that up on the spot and got it out without laughing he might have been mentally alert enough to drive.

QFT. It seems like you have to move to another state to get away from it. I remember back in high school someone getting a DUI; this was 9 years ago. Do I remember anyone else who got arrested for anything? Nope, although I'm sure it happened and I heard about it at the time.

I think it's like being accused of rape. Even though you could be 100% innocent and been given the same verdict in your favor, the accusation is still there; you had the trial, your picture was plastered all over newspapers and on the news, and it'll follow you around.

What I understand about the situation: Man is found near his car... drunk. Police can prove car was driven recently, but didn't catch him behind the wheel with the car on. That the guy can offer any story at all allows for reasonable doubt, negating the nigh-certainty of his conviction. Yay presumption of innocense!

I can empathize with this guy. My freshman year of college I got popped with a DUI after driving my car into a ditch one very snowy night. I walked home and came back later with friend to help remove it. The cop rolls up, arrests me for being drunk, which I wasn't and takes to jail.

Unbelievably, without my being able to testify I'm convicted with a sentence of nine-months. I started pitching a fit about not being able to say anything in court and my lawyer breathes some life into me by telling me to stfu. We appealed and the officer is telling his story on the stand and the judge asks, "Wait a minute, you didn't catch the man driving the car?" The cop says no. Case dismissed. I never had to say a word, but it cost me $500 to get there. Fat cash for a broke college student.

Henrico County, VA has some very small-penis'd cops in their ranks, big surprise. Too stupid to get real cop gigs.
