Some states have laws saying if you open your property for recreational use for free, you are not liable for negligence related to that use. (And so the lawsuit against a Massachusetts agency over a badly maintained bike path said the bike path was for commuter use, not recreational use, but that game doesn't work with sledding.)

How about this: If a judge or jury determines your lawsuit is, frankly, farking dumb, you pay the defendant's court costs. And if you can't afford that, you get to be their slave or something :P

Anybody who has been around bales of hay for more than a few minutes knows that those suckers aren't made out of marshmallows and cotton candy. Those things are just short of being rocks. Which is why hay baling equipment uses several hundred pounds of force to compress them.

Perhaps she should have avoided the bales of hay entirely and sledded out into the road. Then she would have found out how soft cars are compared to frozen bales of hay.

Can I testify at the trial? Can I? I live for this sort of thing ;)

It's WINTER. There's snow and likely ice on EVERYTHING. This woman got on a piece of PLASTIC at the TOP OF A HILL with NO BRAKES and zoomed down towards HAYBALES, which aren't exactly airbags when they're thawed, either.

The fact that she felt somehow that she was less safe than the past 40 FARKING YEARS of people who used the hill for the EXACT SAME PURPOSE and ruined it for everyone with her lawsuit is DEPLORABLE. Instead of taking the blame like everyone else who ever was injured on that hill, she screwed things up for TWO WHOLE TOWNS. SHE SHOULD HAVE DIED AND I HOPE SHE READS THIS AND DOES.

Lawsuits are NOT for use when YOU are the person being negligent. Case farking closed.

Exactly. I use them for archery practice and they're far more solid than the casual onlooker would think. They wouldn't even have to be frozen to do some damage if you hit them badly at a top-sledding speed.

The local county college has a HUGE hill by the employee parking lot. Every time it snows, the maintenance workers are nice enough to put sawhorses & a snow fence at the bottom so that sledders don't end up slamming into parked cars.

However, unless you bail quickly, you end up slamming into wooden sawhorses, instead.

/Every snow there's always a couple of sprains and at least one mild concussion
//So far, no one's stupid enough to sue, as we all know you take your life into your own hands when you're sledding down a 30-degree slope with no way to steer or brake.

Also, I notice you conveniently left out my point about the fact that, for 40(+?) years people had been sledding there. This lawsuit is just ridiculous; someone who is 26 should:
a) know the risks of sledding, especially since she had to arrive at the bottom of the hill and walk up (plenty of time to evaluate the situation and either make a plan or bail! Are those hay bales frozen? How will I stop?) and
b) know the physics of accelerating an object to a high speed (i.e. Newton's Second Law). Did this chick not pass high school?

It's not even like this happened to a naive child, this woman was 26 for gods sake. She could have been a college graduate, and according to the article, she worked at the University of Pittsburgh Medical Center.

No excuses. I don't believe for a second, from the picture or the story, that this hill presented excessive danger for anyone who could be responsible.

You lose your right to ruin something for everyone when you stop being responsible.

There's another thing called personal responsibility. While it sucks that she was injured so badly, sledding into what amounts to a brick wall at however fast she was going is going to cause injury. Maybe it would have been prudent for the county to have signs up warning people not to let themselves slam into the hay, but this isn't something worth suing over, and it certainly isn't something that is worth spoiling the fun for everybody else over.

And here is a much more eloquent summary of my rage-filled words. This one pissed me off more than most because here we have an adult spoiling fun for 2+ towns of children, and derailing 4 generations of tradition.

It sucks that she got hurt, yes, but I don't know how sorry I can feel for a person who sleds down a hill, gets hurt, and when they come to, says "THIS IS SOMEONE ELSE'S FAULT!"

We get one of these care for humanity types in every other thread, and let me give my generic response...

It's people like this woman who make life for most of us less fun. Be it banning sledding, dodgeball in elementary school, or forcing rules where every peon on a little league team has to play instead of the joy of winning. Those pleasures in life being robbed from us, in a way, kill us inside. So I ask you, what is worse, killing one party spoiler, or killing the fun of everyone else.

Before you answer, keep in mind she was 26, sledding, and did not know better than to bail out of a sled before hitting the hay bales. I mean, I know public schools are bad, but every retard with a GED knows basic physics and that energy in motion remains in motion.

My old grade school has awesome sledding hills and when I went there winter was the best time of year. Now they have signs up all over saying no tobogganing. Sucks to be them. Those were the days.

normally while drunk like every other adult sledding without a child present

There are sleds made for adults

if she was drunk then no suit, she was impaired and could have bailed before hand.

If she was using a kid sized sled then no suit, she used equipment not meant for an adult.

I've taken some nasty spills while sledding at good clips, but I have never ASSUMED (even at 5 years old) that somethign that looked soft was guaranteed to be,and usually simply flopped off the sled allowing the snow to slow me down, even if it was icy and tore me up a little.

It's a shame you broke your back. I know a woman who broke her back in a drunk driving accident. Yet I still see cars and booze are available. And she took responsibility for her own actions. Weird huh?

Frivolous lawsuits have a very easy solution. Don't allow lawyers a percentage of the reward. Instead, pay them well like you would any professional with that kind of education. But to cash in on the reward just encourages unnecessary rewards.
