I mean, the submitter used it to make reference to a headline which describes nothing weird, so I think it's reached the point where lazy submitters are just employing it to get a green light on another pointless and uninteresting article.

Well, in the headline, the driver tells the cop he's "wrecked," which isn't too smart. AFTER what is described in the headline, things got weird. To me, that fits the "and then things got weird" cliche. I don't know about you, but I would define someone kicking, cursing, punching, growling at, and biting a police officer as pretty weird.

Some states have enacted a statute criminalizing the refusal to submit to a blood alcohol test. The purpose of the refusal statute is "to encourage all suspected drunk drivers to take the breathalyzer test." The criminal offense of refusing to submit to chemical testing is separate and distinct from the DUI drinking/driving offense. The penalties imposed as a result of a conviction are additional to the penalties imposed if the defendant is also convicted of the DUI drinking/driving offense.

There's some truth to that, but generally speaking it's not a smart idea. Yeah, the MADD types that tell you that you're gonna kill someone if you get behind the wheel after 3 or 4 beers are pretty nuts, but if you can't walk straight you probably can't drive straight either.

Pretty much. Kind of like disturbing the peace or interfering with a police officer -- the laws are so vague that you're automatically guilty if the cop says you are.

I'm surprised they bothered... that's what they charge you with when the cop's pissed off at you and wants to arrest you but you haven't committed any real crime.

So now a refusal is a crime (316.1939) if you previously refused and had your dl suspened for it.

The first refusal is never a crime - you still lose your license administratevly for a year for refusing to submit (even in you are not drunk).

So this assclown refused once before, had his DL suspended (even administratively and not by the court counts) and then refused again last night.

/I dont practice law in Florida, I just live here part time. If you want legal advice find a nice sober lawyer that practices in your state.

Thats why I always carry a bottle of gin with me.

Anytime I have to sign anything that is legally binding, I chug the liquor and wait for it to kick in.

You cant sign a contract drunk....

Before I was carrying a gun, and it would put it against my head when i signed but that really freaked people out. But in court you can always claim you had a gun to your head...
