This seems to be fairly common in the hip hop industry. A lot of famous artists want to 'sample' another person's song, except instead of sampling, they use it as their entire beat. Or add some bass and drums and then use it as their entire beat, and then use it as their beat. When called on it, they say they're just sampling, because everyone in the hip hop industry samples.

Apparently, they don't understand the word sample. Sampling is fine, but you can't just take someone else's song and then call it your own beat. Timbaland is notorious for 'sampling' entire songs and then putting some talentless hack who can't rap or sing over it, and then calling it a hit.

This is the problem they're going to run into. This song was never sold. It was not even officially released by Lil Wayne, it was "leaked" by DJ's who had miraculously gotten their hands on the track. There is no legal culpability whatsoever for Lil Wayne here. This is like if you remixed a Bon Jovi song for fun (and why wouldn't you), sent it to your friend, and Bon Jovi heard it and sued you. There's no case.

Wow - some clarity in a hip-hop thread! Well done. What you just said is absolutely true. Unless it can be somehow proven that Lil Wayne had some hand in leaking the track - which would be next to impossible to prove given the number of people in the average recording / mix session, as well as the fact that mixtape tracks are often created by outsiders and then mixed with a capella tracks from the artist - he isn't going to face any real trouble.

It is important to note that copyright infringement however, does not hinge on the sale of the allegedly infringing work, contrary to popular belief.

On another note, I really wonder how many Farkers who are talking shiat about a "lack of talent" in re: Weezy (or basically any rapper that comes up on Fark) have actually HEARD HIS MUSIC. I would bet the percentage is very low. Reading hip-hop comments on here is a lot like seeing that Greg Allman clip where he says something to the effect of "Rap is crap, y'all". Yucka yucka yucka.

That is teh funnies! Now, back to my basement studio:

Seriously, it will be interesting to see how this issue plays out. Seems like so called mash ups, djs and other directly deriviative or "open source" music is moving more towards commercial popularity. Buncha lawyers and labels are gonna want a cut.

I've heard casual reference to a "fair use" rule that says you can use up to 30 seconds, but i dont know if thats codified or more of a guideline.

That's the beautiful part. If they didn't sell the songs, then all this lawsuit does is give Lil Wayne more publicity. When you sue someone for sampling your music, they often benefit from it.

And that much of the time, even that beat is from a royalty-free sample disc loaded into a glorified 'groove box' or an Akai MPC? And this is how they make money, usually by glorifying sexism, violence, and implying that materialism is the only thing that matters?

Flying Lotus' remix of "A Milli" makes Wayne sound cool, but not because of Wayne.

Stronger is doubly silly because Kanye sampled a sampled song.
