Is there some legal precedent I am unaware of that requires a suspect to be well rested previous to questioning by the police?

If the police are questioning someone and they claim to be tired, are the police now obligated to offer you a nap before resuming questioning or have your statements tossed?

another question - she claims that the diapers were for her children. Which one? She has a boy born in 1992 and twin daughters born in 2001. This happened in 2007. 6 is pretty freaking far along to be in diapers.

So it's not offering her a nap before questioning, as much as coercing her. Any lawyers wanna comment on it? I just read a book about Baltimore Homicide Dept., and they mentioned something like getting a confession after eight hours of questioning didn't really hold water in court because it was looked at as obtained under duress, if I remember right.


The book was "Homicide" (the tv show was based on this book) and it's a good read if you like true life novels.

The difference being that the police caused the duress in that case - they questioned that person for 8 hours. In this case, that was the condition they found her in. Were they legally required to let her rest? Could they hold her in custody while doing so?
