its better to check now and make sure theres no problem, then risk there being one and have a impeachment going, or the american people lose faith in the governments commitment to obeying the constitution

Ah, nevermind. I answered my own question. The source article Kos refers to seems to explain it. Unfortunately Kos chose not to highlight the most important details. (No knock on Kos - the other major news outlets fail to mention it, too.)

BTW, the application is to request a stay of the Dec. 15 vote of the Electoral College until the lower court can hear the case on the merits. (Which, incidentally, also challenges McCain's elligibility by virtue of being born in the Canal Zone.) Yeah, good luck with that.

It's the Berg case, Nabb. I think it's just Berg's cert petition, but the thing is one of the worst written legal briefs I've ever read in my life. The guy cites to Wikipedia, for fark's sake.

This story doesn't make a lot of sense to me, so I am not going to assume that it's true unless and until there's some kind of independent verification from a MSM outlet. Regardless of whether you like or dislike Thomas, he's not insane.

Yeah, but then there's this: "Hawaii Revised Statute 338-17.8 allows registration of birth in Hawaii for a child that was born outside of Hawaii to parents who, for a year preceding the childs birth, claimed Hawaii as their place of residence"

Like I said, the name of the hospital would stop this shiat.

I didn't like the idea of that one even going to SCOTUS. I kind of feel the same way about this. I need to be convinced that SCOTUS should be reviewing this. I'm not clear on the stipulations and actual charges in Berg's suit. Isn't it really that he's been denied access to the documents or something like that?

The major cable news networks were saying he was born in Hawaii plenty.

In fact, Fox News had an hour long biography which covered Obama's parents before he was born, Obama being born in Hawaii, explained his father's trips back to Africa and dealt with his mother moving from Hawaii to Indonesia. Hell, the Fox News biography was pretty even handed (although the editors did get their claws into it a bit for some narration fun I think).

No, but I'm guessing this would be a 9-0 vote, not a 5-4 vote with the most ridiculous opinion SCOTUS issued since Dred Scott.

Of course the issue here is actually standing, not the merits. Which I don't think anyone who has brought a suit actually has. I'd guess that only Electors and Presidential Candidates (and probably only John McCain here, considering none of the others have could show any specific harm to them as they wouldn't win anyway) have standing to challenge this.

Actually, you have to be a natural-born citizen. Which says to me that if you were a citizen when you slid out of your mama, you're natural born. Ms. Durham, being an American, couldn't give birth to a non-natural-born child no matter where she was.

You know, you actually make an interesting point. Who exactly IS the authority? Congress? Some agency? Who's got the stamp that says, "Yeah, he checks out."?

Maybe that's the question we should be asking first. Then see what that entity has to say on the matter.

Meh, its just Republicans grasping at straws. Dems would do the same.

In 2000, there was a question whether Cheney could be permitted as VP because he was from Texas and only shifted his residence to Wyoming at a late date. If I recall there were some desperate court challenges on that as well.
