What do you call it when you help the person who took something without paying for it?

I did try and virtually walk on his lawn today, but the computer froze.

He wasn't trying to stop the foreclosure, he was trying to stop the repo goons from roughing up the debtors.

You can interpret it that way. I interpret it as:

"Look lady, get out of the way. We have the authority to take this."

"NO! I'm not moving. If you want to get past, you'll have to move me!"

"OK, you're call."

When it comes time to actually foreclose, the police and lawyers show up. There should be a modicum of professionalism involved.

Oh, and lawyers and lawmen may be de rigueur in the US, but this was Australia*. Also, it sounds as if they were simple repo men picking up the plasma and Blu-Ray player, not foreclosure guys kicking them out of the house.

*I'm not saying it's not that way Down Under, just that what's tradition here may not be there.

Of course, this being Australia, the old guy will be charged and jailed for assault and the repo-guy will successfully sue him for emotional damage.

RTFA. It got physical because the two repo a-holes started to shove someone around. They started it. Then one of the fools accidentally ran into a fist.

My brother-in-law witnessed an amusing altercation. It was late night in the Japantown section of San Francisco (yes, that's what they call it). Three "youths" not from the area spot a little old Japanese guy shuffling along, walking with the help of a cane. They made the mistake of trying to rough him up. My brother-in-law said he never saw the cane move, but he heard three rapid "thunks", followed by the three punks falling down. The little old man continued his walk. He was probably some kind of Kendo master. I'd also guess the local youths knew better than to f--- with him.

Don't count on it. I worked a a debt collector a few years ago. I'd say the creditors started as many fights as the debtors.

If the homeowner got in the way of a lawful repossession, the collectors should have called the police or sought further remedy in court. Manhandling the debtor just gets your ass kicked by a 78-year-old preacher with rock-hard abs. And rightly so.

Uh, that should be the way in any English common law country, not just Australia. The re-possessors have the right to the property. The article clearly only interviewed the old guy and the debtors, so the issue of "who shoved who first" is still up for grabs. And, fortunately, the repo men's word will win in court as they're the professionals in this situation.

Heheh, there was a story about a WW2 vet taking out a teenager who tried to mug him a while back as well. I guess now that the "Greatest Generation" is getting on these feats of badassery from the elderly will continue for a while.

My grandfather once drove up, pale and covered with blood which seemed to center around his arm. One of his cows and thrown him into a wall where an exposed nail tore a good gash out of his arm. He asked for some band aids. My mom took him to the hospital. I think I would probably be unable to do anything but scream if that happened to my arm.

OgreMagi: He was probably some kind of Kendo master.

My speculation is that those individuals who can really kick some ass (and not necessarily just the showmen martial artists) are the ones you don't suspect. It doesn't involve being very muscular or overt.

sycraft 2008-11-30 03:31:07 AM
Those of you who seem to think the repo men can do no wrong need to go meet some one of these days. I've never been on the receiving end (I pays my bills) but I've met a few and there are some thugs that work in that business.

Some people who go in to it I'm sure are just people who are looking for a job. However others, well it's the same thing as the bully cops. They go in to it because they like to push people around. They want to get to be tough guys and this job allows them to do it.

I'm going to have to side with the boxer here. In my experience, most people with professional combat training don't just run around attacking people without good cause. They have an understanding of personal combat, and the harm it can do. They've been there and done that, as they say.

My bet is that these guys were being jerks, decided that they had the right to shove people around, and he showed them that if you are going to play tough guy, you'd better make sure you are indeed the toughest in the room.

As a practical matter, you don't have the right as a repo man to physically handle the people you are repossessing from. You aren't a law enforcement officer. You don't have arrest powers or the like. You have the right to take the property, as they property's rightful owner has asked you to do so. However, in the event that there are barriers in your way, you have to deal with them legally. If a person is physically barring you, you need to have the police deal with it.

Same deal with entry. Repo men can't break in to a house and take things. That's still breaking and entering. While the company that hires them may be the lawful owner of a TV in the house, that doesn't make them the owner of the house itself. If they break in, they are still breaking the law and can go to jail for it.

I've nothing but respect for people that do hard jobs like repo men, police and so on that act with professionalism and respect. You are the ones in the right and being upstanding is your job. I respect you when you do that. I've nothing but contempt for those that think that their job makes them a tough guy, and they have the right to shiat on those they don't like.

Schmapple: obvious troll is obvious.

Did you read the article? This isn't journalism, it's a biased feature about a plucky old man who beat up "bad guys." We don't know who really started getting physical and why. From experience, I would put my money on the dirtbag debtors wanting to hang on to the 52" HDTV and sound system they haven't paid for in 6 months.

My grandmother used to be a repo woman, and was just a couple days ago telling me of her experiences. She was apparently pretty good at her job since she kept it quite a while, but sometimes if the person or family seemed to either really need the item or just be having a rough patch, she'd go easy on them; she was saying particularly if they had kids, she'd often find herself returning to the office with an excuse like "Oh, you should see that car! It's not worth the trouble to reclaim it -- you'd never be able to resell it, it's so trashed."

I think this story doesn't really lead anywhere beyond that.

Pretty sure assault is not legal regardless of the victim's state of financial debt. This fellow was pretty definitely stopping a crime rather than aiding one.
