The album title In Your Honor comes from his experiences out on the campaign trail with Kerry playing for an audience unfamiliar with the Foos.

I was listening to Tool & Rage's collaboration on the unreleased track "Revolution" just a few hours ago. "You can kill the revolutionary, but you can't kill the revolution." Awesome stuff.

I wonder if there's a full list of artists who have objected (not just this year) to presidential candidates using their music. And if any of the campaigns have ever tried to get permission.

I agree. I'm no fan of McCain or his practice of appropriating artist's songs for his own message, but if an artist sells their music rights to a record label, they have no right to complain. What they should be standing out against is the music industry and the difficulty for artists to retain their own music rights.

There is a difference between getting permission from the artist and paying appropriate license fees. Their songs are available to the public, not just the people they like.

However, there are many artists who hold rights over who they will license music to. You hear this a lot in movies and television where they say "Well we wanted to use (blank) but Led Zeppelin/Prince/The Beastie Boys (I use these as examples because I've heard them a lot) wouldn't give us the permission. So we ended up using (blank)."

If it is this situation, where they own the rights and decide who does get to use it, which from what little information they're giving us here it seems that they are, then they are infringing on the rights of the Foo Fighters.

Dave Grohl is smart enough to hold the rights to his own songs, I highly doubt that some big wig at the record label gets to decide who gets to use what for him.

Their songs are available to the public, not just the people they like.

Thanks for the info. I thought you just paid a fee to ASCAP or somebody, and could use music controlled by them. McCain should just play songs from the public domain, like Ole Dan Tucker.

Like I said, it depends heavily on who owns the music. Like the story about what broke up Paul McCartney and Michael Jackson's friendship, where MJ bought the rights to a lot of songs by the Beatles and then started selling them off for use in Nike commercials. McCartney was pissed, but had no say in the matter.

There are plenty of groups out there who would probably be more than happy to allow McCain to use their music, but apparently the people in his campaign seem to have a "it's better to ask forgiveness than it is permission" type of stance when it comes to who they use music and video from (the "We're not worthy" bit from Waynes World also comes to mind). They've had themselves a long history of it this entire campaign. It's really rather stupid of them because in the end they're going to end up paying more for using it without permission when the owners come knocking on their doors.

My impression is that the use of the songs in the arenas and whatnot is legitimate; just like any bar or event that has music over the PA system. So they may not like it, but it is just one of those things that you have to grin and bear, because the licensing fees are paid normally.

The Jackson Browne song, however, was used in an advertisement, and thus is subject to different licensing regulations. In that case, Browne was in the right to file a C&D. That was also a dick move, because the music in a commercial much more strongly implies endorsement or at least agreement by the artist, regardless of the law.

In this case of background music performance, the artists are free to raise a stink to make their political point, but I haven't seen any report of results for them.
