when I was an ADA, the alcohol-enforcement guys had all these teenage girls they took around to do their narcing for them. They were all jailbait types with troubled home lives, etc.

Every time one of those cases came up for trial and the guy showed up with the informant, all the ladies on the courtroom staff would start telling me how they were convinced the guy was tapping the informant.

This happened to me when I was working at a convience store in Palmdale, Ca. Some dude came in, wanted to buy a beer, showed his id upon request. However, I only looked at the "WILL BE 21 in 1995" as opposed to looking at his actual birth-date. Dude walks out, cops walk in and give me a ticket along with a court date. 40 hours of community service was my punishment for pleading no contest. I told that piece of shiat sheriff explorer that if he showed up at my court date I'd beat the fark out of him. Punk ass biatch never showed up. Did my community service at the Goodwill.

I'm 35 years old and recently got carded for cigarettes. You only have to be 18 to buy cigarettes, and while I'm not going to post my picture, there is no way in hell any sane person could believe I'm under 18.

But I don't mind, they're just doing their job. In some stores if you fail to ask for ID from a person who looks under 30 you can get fired.

When I worked at Sunoco, we had undercover people come in sometimes like that. It was always painfully obvious... Once they parked right in front of the door and I knew it was an undercover car.

But one time this guy came in, who was clearly old enough, at least in his 30's, and started complaining about how long it took me walk to the register to wait on him. (I had been in the cooler stocking something, and didn't hear the door, and he hadn't been waiting more than a minute anyways) He started calling me names, and then asked for a pack of Marbs. I very politely asked him for his ID, which he didn't have, and he cursed up me up and down and left.

Good times.

I've always wanted to own a tobacco shop with signs clearly stating that nobody under the age of 18 is permitted inside without parent or guardian. Every time one of these kids comes in I'd call the police to have them arrested for trespassing. I'd love to see some little 16 year old brat who's trying to take my livelihood away from me saying, in between sobs, "this isn't what was supposed to happen, I was supposed to do this and then get out of my curfew violation!"

Uh.. That's a myth, propagated by screenwriters and stupid criminals. Undercover cops certainly can and will lie, there's no "magic questions" that make them have to out themselves.

Entrapment makes it easier for a good lawyer to defend you, but it's not a technicality either.

Had a police test purchase just last night in my pub so getting a kick etc...
bonus was the id's they handed over were fake and I confiscated them then had the kids thrown out.
double bonus. the police had to come in to ask for them back.
triple bonus. I'd already cut them in half

If they say they're 18 they're guilty of entrapment. In any event, it'd be something I'd play by ear.

And it doesn't matter who they're working with, if they don't have a warrant, and they're otherwise not supposed to be there, they're trespassing. I'd escalate the issue if necessary.

Just like a cop can't sit in your driveway doing speeding detail if you ask him to leave. Nobody is above the law. The sign, in effect, asks them to leave.

And yes, I'd look the same way on fake IDs, and other brats that came in. Yes, I'd be a popular sonofabiatch.

I'm sorry to inform you, they can CERTAINLY lie. You're perpetuating a myth(I once held it too so don't be ashamed). Police and their informants can lie all they want, whether their lives are in danger or not(that used to be another part of the same myth).

Years ago when I was 'down and out' I ended up working at a liquor store (owner was an assh*le, but I digress. He told me to follow black people around the store because they steal. I didn't tell him that white people steal also and in fact I was taking stuff home almost every night - cigars, pints, anything that fit in my pockets.). It was mildly fun.

One lazy Thursday (maybe), some waaaaayyyyy underage girl with a squeaky voice came in and wanted a pack of cigarettes. Duh! I asked for her ID just to make sure she wasn't a slow developing 18yo. I looked at her ID and laughed and told her "I don't think so." She left and not even a minute later a cop came in and gave me a 'certificate' and a pin.

Almost the weirdest day at work at that job.

This BS (as well as DUI checkpoints) are ridiculous. Here you have the cops send someone in to a place of business to try to get someone to accidentally commit a crime. Should 15 year old kids be buying a 12 pack a night? No, probably not. That isn't the problem. Most clerks recognize a minor. The problem is we have changed the law so some adults can't purchase a legal substance (alcohol). We are letting idiots 18 years old vote in November. We let 18 year olds join the military. We let 18 year old people enter into legally binding contracts. However, we arbitraraly pick 21 as a magic second age at which people are considered adults. Some people at 25 look much younger. Some at 20 look much older. Cops like to play these games because there is no risk. A store clerk isn't likely to shoot the cop. However, someone committing a real crime might.

That isn't entrapment, and you'd get nowhere claiming that it is.

And it doesn't matter who they're working with, if they don't have a warrant, and they're otherwise not supposed to be there, they're trespassing. I'd escalate the issue if necessary.

They'd only need a warrant if they are searching or seizing, they are doing neither. You're operating a business that is open to the public and they are going in to purchase something from your business. They are not trespassing.

Think of it like this, bars have signs that say "no one under 21 allowed". Not only that, they check IDs at the door. Now what happens if that bar gets raided and they find people under 21 in that bar with fake IDs? If you guessed the bar gets fined/loses it's license, you're correct. It doesn't matter that the kids lied and had fake IDs, the bar still gets busted for not being vigilant enough to keep them out.

In short, it doesn't matter if they lie to you, you still provided a controlled substance to someone underage so you're SOL.
