NCO called me 10 years after I was divorced about a bill my ex was supposed to take. I told the guy that his statute of limitations was up, but call her, and quit calling me. As to date, she's never heard from them, and they quit calling me.

I've seen the death notice in the contracts of the usual scummy corporations..

27. BINDING NATURE: This Agreement shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, executors, administrators, successors and permitted assigns.

So even in death. You still is screwed over. But Judges are smarting up to one sided contracts and ruling that since half the contract is illegal,,, The whole contract shall be deemed VOID. So next time write a contract that does not guarantee first born and a toe to signify agreement to contract.

This story is such bull, I used to work for T-Mobile customer care for 5 years. the policy if someone calls in to say a relative died is to cancel the service no questions asked, they dont have you send in a copy of the death certificate. However all charges are billed for sevices allready used, and the bills are not genarated until AFTER the bill cycle has closed.
And if the bill does not get paid by the next of kin then it will be send to a collection agency just like any other past due bill.
You would be amazed to find out how many people think they call in on a past due account and say the owner died to try and get out of paying there bill, then try to open a new account under the same name and social security number.

Who's bill? If your customer dies, you have every right to collect from the estate of the deceased, but to go after the next of kin is illegal in most states. It is also a shady business practice and not one that a moral person would admit to doing in public.

It's believeable. Bell Canada sent bills to one woman for over a year and she wasn't even a customer, nor had she ever been. Funny how companies built on communication services fail at communicating.

My 70+ Dad had a similar situation settling the estate of a relative. After about the third collection he told them she had moved and to send the bill to Lake Cemetery, Plot 294.

Well you must be getting a kick! So if I get your point, you're saying that the $163.12 arose from services rendered while the decedent was alive? If that's true, fair enough -- the estate must satisfy outstanding debts. However, it seems service was cancelled in early April, but continued through July, which was the source of the challenged debt.

FTFA: In an e-mail the company says the matter has been resolved. It wouldn't offer an explanation, citing company policy.

"We don't explain. We don't have to. We're the Phone Company."

My father-in-law died in July. They went through Sprint (I think, maybe Verizon, sorry if I libel anyone). So they had one of them family plans, one line, buy another line. 2 phones total. My wife stayed to handle lots of things after the funeral so her mom wouldn't have to deal with it. So she calls the phone company and tells them what happens and they tell her that her mom will have to pay an early termination charge, around 300 bucks. My wife freaks, tells them she will fax the death certificate, whatever they need. She is still told that they will have to pay the early termination fee. He's farking dead for god's sake.

As far as I know, it still isn't resolved. Unbelievable.

The official policy for both carriers is to waive ETF if the customer is deceased. You may be asked to provide some proof of death, which is reasonable.

If you don't mind my saying so, I'm sure your wife would really appreciate it if you went ahead and sorted this out for her.

I found a way to get out of mine. I just had to tell Verizon I had a dead zone (you know, those things they swear don't exist on their network) in my apartment. They sent out techs and discovered that the signal quality is poor enough that the walls do compromise the signal. Now I can cancel any time I want.

Of course the problem is that, even if you pass on the free phone, any reasonably priced plan with a good network comes with a contract.

My question to you is, who's name was the account under? If it was under your father-in-law's name, then you're right, they're in the wrong and they should disconnect one of the lines and see if your mother-in-law wants to take over the account or if they want to move her line to someone else's account. But if the account was ini your mother-in-law's name, they're completely in the right as it wasn't her that's passed on and the account is her responsiblity.

They can suck the lint from my balls. I just got out of a Sprint ETF (was with them for 13 years before I finally wised up and got out. They wanted to ETF me over 2 months... even though, at my new residence, I have to drive 10 miles to get a signal. I pointed them to this CA ruling (poppety goodness) and told them to blow it out their asses. I got a credit statement in the mail a week later showing the ETF dropped. fark them and fark bottom feeding scum suckers. fark fark fark em.

/ahhhh... that felt good.

Here's how it works for those who haven't had to deal with a death or an estate.

-Make a list of all of the bills that person has.
-Discontinue services immediately that won't be used like phones and car insurance.
-Change the main address and phone number to whoever is handling the billing.


- GET about 10 OFFICIAL(notarized / county seal) COPIES OF THE DEATH CERTIFICATE
You can always get more, but I guarantee you're gonna need some.

Be prepared to mail a few to some companies when you're ending services. Most will take a xerox copy. Banks and financial institutions will require you mail an original.

Be prepared to deal with shiat like this, including any lingering hospital / Medicare / Medicaid charges for equipment or services.

It's part of life/death. Sorry.
