DeLeo cited a section of state law that bars the issuance of concealed-weapons permits to people who are deemed a danger to public safety based on their character and reputation. Hain showed poor judgment by wearing her gun at the game, he said

She's going to win in court I take it.

Yes. It's been done before. A gun in a holster is not a threat to public safety.

She'll win at the hearing, and DeLeo will get sued and lose.

Revoking a CC permit in PA based on open carry has been litigated more than a few times in Pa., and the Sheriff always loses.

Mine's either on my hip or in the pistol safe, so the kids don't have access to it. Those who leave firearms unlocked are the ones who aren't serious about responsible firearms ownership. I'd bet this lady has her shiat together on that front.

caffeine_addict 2008-09-25 02:35:21 PM
She'll win in court. The Sherriff showed poor judgement in revoking her permit. So may have shown poor judgement (which is subjective) but I don't think, from the article, she demonstrated she is a danger to the public by action or reputation.

I grew up about 15 minutes east of Lebanon and walked those streets many times. Ain't the first person openly carrying a gun around those parts and won't be the last.

Scutter 2008-09-25 02:35:38 PM
I'm impressed that the sheriffs in PA are passing their own laws now. Saves all that trouble with dealing with that pesky legislature.

Litig8r 2008-09-25 02:35:44 PM
Oh, and she needs a new holster. The one she is using is for a G19, not a G26, which is why it looks so damned big.

In Pa. you can OC without a permit, but the second you get into a car, your weapon is concealed, and you can be arrested unless you have a CC permit.

Is there something going on at a 5 year old's soccer game that necessitates packing heat? I'm for her right to own and carry a firearm. There is no need, none whatsoever, for her to be carrying at a soccer game. You might argue "well, what if a fight breaks out?". Um, yeh. Do you think pulling your piece (or even showing it) is a justified and reasonable response to anything except someone else pulling theirs? Put it in the car and lock your car or leave it at home.

How difficult is it to get a CCW in PA? I've just moved to the state and have spent way too much time over in today's tin-foil thread. Thinking I might want to get some things stocked up just in case.

25 bucks for the application at the local sheriff's office, and a quick background check.

I bet it doesn't happen.

There are more than 200 million guns in the United States, yet in 2005 there were only 75 accidental gun deaths among children 14 and under (age range chosen to eliminate most hunting accidents).

Even if you go with a child being defined as age 0 to 17 (18 and older being an adult), the number is still vanishingly small: 127 that same year.

Her kid has a much better chance of drowning: 1,057 in 2005 (0 through 17),
Being accidentally poisoned: 457

Her kid also has a better chance of dying in a bicycle accident: 177.

I've lived in a number of north-eastern states and I've noticed that the tougher the state is on guns, the looser it is on alcohol. So... NJ: forget about it, you can't have a gun, but liquor stores are EVERYWHERE. Ohio: About in the middle on both. You can buy Beer and Wine anywhere, but not hard alcohol. PA: Guns are prominent but you can't even buy beer and wine in the same place.

CCW lets you have a loaded gun in a vehicle. Anything in a vehicle is considered "concealed".

But yes, it's perfectly legal to walk thru downtown H-Burg wearing a rifle on your back.

It's also legal to climb on your roof in a thunderstorm. It doesn't mean it's a good idea.

/Loves guns
//thinks this sheriff needs to DIAF
///and have his CCW revoked for displaying poor judgment and posing a danger to the public due to character and reputation.

...and of course nobody has ever started shooting at school kids before, so why should she want to be able to protect her kids if it does happen there?

Sort of.

Now that her CC permit has been pulled, she'll have to unload the gun before she gets in the car, lock it in the trunk in a separate container from the ammo, drive wherever she's going, and then get out and reload.

Or just ride a motorcycle.

But like I said, she's going to beat the denial, and win the lawsuit, so she should be smiling right about now.

If you know in advance when you will need your weapon, then you would know not to go there in the first place. PA carry permits have been revoked after guns have been taken from cars, so there is something of a catch 22 there. For my part I'd rather gun owners had control of their guns at all times - ie they should be in a holster or locked in an immobilized safe. I wouldn't leave my guns in a vehicle.

eKonk 2008-09-25 02:44:36 PM
While I'm not going to ask why she carries to a kid's soccer game, I am curious as to why she didn't carry concealed. The whole point of concealed carry is so you can have the means to defend yourself without getting other people nervous about the gun on your hip.

That said, the sheriff is a dumbass. The headline could have read "Woman loses her concealed-carry permit for legally openly carrying her handgun; will now be forced to carry her handgun openly"

Packing an equalizer at a kids' soccer game. Awesome. Especially because parents NEVER get irrational about the score and become threatening to the coaches or other parents.

It depends on the county. Delaware county and Philadelphia is somewhat more difficult. Lackawanna county (where I used to live) was 25 dollars (cash) 3 references (2 non family and you'll need social security numbers with them, so that's the hard part, I guess they figure anyone who trusts you enough to give you their social will testify to your character) and you can walk out with it the same day.

How is it poor judgement to have a gun on you, especially if you have a Concealed Carry Permit?

She's minding her own business, and since other parents are freaking out over her gun, she gets her permit taken away. Makes no sense.
